S.I. No. 207/2003 - Data Protection (Amendment) Act 2003 (Commencement) Order 2003


I, Michael McDowell, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 23 (3) of the Data Protection (Amendment) Act 2003 (No. 6 of 2003) hereby order as follows:

1.        This Order may be cited as the Data Protection (Amendment) Act 2003 (Commencement) Order 2003.

2.        The 1st day of July 2003, is fixed as the day on which the Data Protection (Amendment) Act 2003 (No. 6 of 2003), other than -

 (a)       section 5(d), in so far as it inserts subsection (13) of section 4 of the Principal Act,

 (b)      section 16, and

 (c)       section 22, in so far as it repeals the Third Schedule to the Principal Act,

comes into operation.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order brings into operation the Data Protection (Amendment) Act 2003 with effect from 1 July 2003, except section 5(d), in so far as it inserts subsection (13) of section 4 of the Data Protection Act 1988 (which relates to enforced access in connection with employment) section 16 and section 22 in so far as it repeals the Third Schedule to the Data Protection Act 1988 (which relate to registration of data controllers and data processors).
