S.I. No. 81/2003 - European Communities (Fresh Meat and Poultry) (Checks on General Hygiene) Regulations 2003
I, Joe Walsh, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Decision 2001/471/EC of 8 June 20011 hereby make the following regulations — 1. These Regulations may be cited as the European Communities (Fresh Meat and Poultry) (Checks on General Hygiene) Regulations 2002. 2. The European Communities (Fresh Poultrymeat) Regulations 1996 ( S.I. No. 3 of 1996 ) are amended — | ||||||||
(a) by inserting, after Regulation 3 — | ||||||||
“3A(1) A person shall not use an establishment for the production, rewrapping, cutting or storage of fresh poultrymeat unless he or she has in place a procedure that complies with Article 1 of Commission Decision 2001/471/EC of 8 June 2001 and conducts regular checks on the general hygiene conditions in the establishment in accordance with that Article. | ||||||||
(2) This Regulation shall not apply to an establishment to which Regulation 3(4) of these Regulations applies until 8 June 2003.” | ||||||||
(b) by substituting “€3,000” for £1,500” in Regulation 19. 3. The European Communities (Fresh Meat) Regulations 1997 ( S.I. No. 434 of 1997 ) are amended — | ||||||||
(a) by inserting, after Regulation 3 — | ||||||||
“3A(1) Notwithstanding Regulation 12, a person shall not use an establishment for the production wrapping, rewrapping, cutting, storage packaging or repackaging of fresh meat unless he or she has in place a procedure that complies with Article 1 of Commission Decision 2001/471/EC of 8 June 2001 and conducts regular checks on the general hygiene conditions in the establishment in accordance with that Article. | ||||||||
(2) This Regulation shall not apply to — | ||||||||
(i) an abattoir to which the Abattoirs Act 1988 (No. 8 of 1988 applies, | ||||||||
(ii) a cutting plant in respect of which a derogation has been granted under Regulation 6(5), or | ||||||||
(iii) a cold store in respect of which a derogation has been granted under Regulation 6(6), | ||||||||
until 8 June 2003.” | ||||||||
(b) by inserting, after “microbiological checks” in Article 12 (1)(a) “carried out in accordance with Article 2 of Commission Decision 2001/471/EC of 8 June 2001.” | ||||||||
(c) by substituting “€3,000” for £1,000” in Regulation 20. | ||||||||
