S.I. No. 626/2002 - Airport (Amendment) (No. 2) Bye-Laws, 2002


Aer Rianta cpt, in exercise of the powers conferred on it by Sections 16 and 17 (as amended by the Air Navigation and Transport Act, 1988 (No. 15 of 1988)), of the Air Navigation and Transport Act, 1950 (No. 4 of 1950) and by Section 42 of the Air Navigation and Transport (Amendment) Act, 1998 (No. 24 of 1998), hereby makes the following Bye-Laws:

CITATION

1.   These Bye-Laws may be cited as the Airport (Amendment) (No. 2) Bye-Laws 2002. These Bye-Laws together with the Airport Bye-Laws, 1994 the Airport (Amendment) Bye-Laws, 1999 and the Airport (Amendment Bye-Laws, 2002, shall, subject to the provisions hereof, be construed together as one and may be cited together as the Airport Bye-Laws 1994 to 2002.

APPLICATION

2.   These Bye-Laws shall apply to the State Airports known as Cork Airport Dublin Airport and Shannon Airport.

AMENDMENT

3.   Bye-Law 9 of the Airport Bye-Laws, 1994 ( S.I. No. 425 of 1994 ) is hereby repealed and a new Bye-Law is hereby inserted in substitution for the said Bye-Law as follows:

Speed Limits

9            (1) Speed limits for vehicles being driven within an airport shall be as follows:-

(a)        15 kilometres per hour (10 miles per hour) in car parks and elsewhere as indicated;

(b)        32 kilometres per hour (20 miles per hour) in the movement areas, and

(c)        45 kilometres per hour (30 miles per hour) elsewhere such speed limits being indicated on signs erected by Aer Rianta;

(2) A person shall not drive a vehicle (other than a fire fighting or rescue vehicle, ambulance, or a vehicle under the control of a member of the Garda Síochána, the Airport Police Fire Service or the Defence Forces in the course of his or her duty where the security of an airport is threatened) on any airport or any part of any airport at a speed exceeding the speed limit specified by paragraph (1) of this Bye-Law for an airport or that part of an airport.”

EXPLANATORY NOTE

These Bye-Laws replace Bye-Law 9 of the Airport Bye-Laws, 1994, with a new provision altering the maximum speed limit from 25 kilometres per hour (15 miles per hour) to 32 kilometres per hour (20 miles per hour) for motor vehicles, bicycles and other forms of land transport or conveyances in the “movement areas” (the parts of an airport used for the take-off landing and taxiing of aircraft including aprons) at Cork Airport, Dublin Airport and Shannon Airport.
