S.I. No. 434/2002 - European Communities (Second General System For The Recognition of Professional Education and Training) (Amendment) Regulations 2002


I, [illegible] Minister for Education and Science in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive No. [illegible] of 25 February 2000. hereby make the following regulations:

1.  (1)        These Regulations may be cited as the European Communities (Second General System for the Recognition of Professional Education and Training (Amendment) Regulations 2002.

(2)        These Regulations shall come into operation on 20th August 2002.

2.   Regulation 2(1) of the European Communities (Second General System for the Recognition of Professional Education and Training) Regulations. 1996 ( S.I. No. 135 of 1996 ). is amended by substituting for the definition of “the directive” the following:

“ ‘the Directive’ means Council Directive No. 92/51/EEC2 of 18 June 1992 as amended by Commission Directive No. 94/38/EC of 26 July 19943 , Commission Directive No. 95/43/EC4 of 20 July 1995, Commission Directive No. 1997/38 of 20 June 19975 and Commission Directive No. 2000/5/EC1 of 25 February 2000;”

Expalantory Note

(This note is not part of the instrument and does not purport to be a legal interpretation)

The purpose of these regulations is to give legal effect to Commission Directive No. 2000/5/EC6 of 26 February, 2000 which provides for the amendment of Annexes C and D to Directive 92/51/EEC. Annex C to Directive 92/51/EEC is a list of courses which have a special structure as outlined in Article 1(a)(ii) of that Directive. Annex to Directive 92/51/EEC is a list of courses which have a special structure as outlined in Article 3(b) of that Directive. The amendments relate to courses in Austria and the United Kingdom.
