S.I. No. 252/2002 - Criminal Justice (Theft and Fraud Offences) Act 2001 (Commencement) Order 2002


I, John O'Donoghue, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 1 (2) of the Criminal Justice (Theft and Fraud Offences) Act 2001 (No. 50 of 2001), order as follows:

1.       This Order may be cited as the Criminal Justice (Theft and Fraud Offences) Act 2001 (Commencement) Order 2002.

2.       The 1st day of August 2002 is fixed as the day on which the remaining provisions (other than section 57) of the Criminal Justice (Theft and Fraud Offences) Act 2001 shall come into operation, that is to say:

(a) Parts 1, 2, 4 and 6, and

(b) section 16 to 22, 54 to 56, 59, 60(2) and 61 to 65.

Explanatory Note

(This is not part of the instrument and does not purport to be a legal interpretation)

This Order brings into operation all sections of the Criminal Justice (Theft and Fraud Offences) Act 2001 not already commenced, with the exception of section 57 (Provision of information to juries).

Other than Section 57 (Provision of information to juries), the sections not already commenced at the coming into force of the Act on 19 December, 2001, come into operation on 1 August, 2002.

The following provisions came into effect on 19 December 2001 with the coming into force of the Act: Parts 5 (Counterfeiting) and 7 (Investigation of Offences). Sections 23 (Amendment of Criminal Justice Act, 1994 re designation of certain states or territorial units), 53 (Summary trial of indictable offences), 58 (Liability for offences by bodies corporate and unincorporated) and 60(1) (Evidence in proceedings).
