S.I. No. 138/2002 - Inland Post Amendment (No. 62) Scheme, 2002


An Post, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), hereby makes the following Scheme:

1.     (1) This Scheme may be cited as the Inland Post Amendment (No. 62 Scheme, 2002.

(2) This Scheme shall be operative with effect from the 1st day of April 2002.

2.   In this Scheme “the Principal Warrant” means the Inland Post Warrant, 1939 ( S.I. No. 202 of 1939 ) as amended.

3.   Words defined in the Principal Warrant shall have the same meaning in this Scheme.

4.   Paragraph 3 of Regulation 6 of the Principal Warrant is hereby revoked and the following paragraph shall be substituted therefor:-

“(3)- Consisting of or containing-

(a)  Dangerous, toxic, poisonous or infectious substance;

(b)  explosive substance of any type;

(c)  munitions of war;

(d)  firearms;

(e)  corrosives, acids, paint removers;

(f)   oxidising substances or organic peroxides;

(g)  compressed liquidized or dissolved gases;

(h)  dry ice;

(i)   flammable solids or liquids;

(j)  materials liable to spontaneous combustion;

(k)  paints, varnishes, dyes;

(l)   radioactive materials (except under licence);

(m)  living creatures and vegetables;

(n)  prescribed or dangerous drugs (except under statutory licence);

(o)  mercury materials deemed illegal or prohibited by any Government Authority;

(p)  organic or biological materials likely to perish in transit;

(q)  sharp instruments not properly protected; “

5. Paragraph I of Regulation 28 of the Principal Warrant is amended by the substitution of the following for parts (c) thereof-

“(c) Where a postal packet does not bear the sender's return address or some indication of origin of the sender, An Post shall have the discretion to destroy or otherwise dispose of the said packet.”

This Scheme applies to the Inland Post Service and comes into operation on the 1st April 2002. It updates the list of prohibited items and imposes a requirement for a return address to be placed on all items.
