S.I. No. 547/2001 - European Communities (Prohibition of the Export of Certain Goods and Services To Afghanistan and Strengthening of the Flight Ban) (Amendment) (No. 2) Regulations, 2001

I, Mary Harney, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Regulation (EC) No. 1996/2001 of 11 October 20012 , hereby make the following regulations:

1.        These Regulations may be cited as the European Communities (Prohibition of the Export of Certain Goods and Services to Afghanistan and Strengthening of the Flight Ban) (Amendment) (No. 2) Regulations, 2001.

2.        The following Regulations are substituted for Regulation 2 of the European Communities (Prohibition of the Export of Certain Goods and Services to Afghanistan and Strengthening of the Flight Ban) Regulations, 2001 ( S.I. No. 417 of 2001 ):

“2.    In these Regulations ‘Council Regulation’ means Council Regulation (EC) No. 467/2001 as amended by Commission Regulation (EC) No. 1354/2001 of 4 July 20011 , Commission Regulation (EC) No. 1996/2001 of 11 October 20012 and any Regulation made by the Commission, subsequent to 11 October 2001 (including a date falling after the making of the regulations specified in Regulation 2A of those Regulations), which amends one or more of the Annexes to that Council Regulation.

2A.   The regulations mentioned in Regulation 2 of these Regulations are the European Communities (Prohibition of the Export of Certain Goods and Services to Afghanistan and Strengthening of the Flight Ban) (No.2) Regulations, 2001.”.

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation).

The effect of this Order is to further amend the Statutory Instrument that provided for penalties for infringements of the EU Council Regulation (EC) No. 467/2001 concerning the prohibition of the export of certain goods and services to Afghanistan and strengthening the flight ban, to take account of amendments made to Annex VI. These amendments give effect to Commission Regulation (EC) No. 1996/2001 of 11 October 2001 and any further Regulations made by the Commission which amends one or more of the Annexes.
