S.I. No. 438/2001 - Company Law Enforcement Act, 2001 (Commencement) (No. 2) Order, 2001

I, Mary Harney, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 2 of the Company Law Enforcement Act, 2001 (No. 28 of 2001) order as follows:

1.       This Order may be cited as the Company Law Enforcement Act, 2001 (Commencement)(No.2) Order 2001.

2.       In this Order “Act” means the Company Law Enforcement Act, 2001 (No. 28 of 2001).

3.       The 1 October, 2001 is fixed as the day on which sections 47, 62, 66 to 71, 75 to 79 80 to 83, 85 to 87, 89, 90, 91(b), 92, 93 (except in so far as it inserts subparagraph (ii of paragraph (fa) into section 213 of the Companies Act, 1963 (No. 33 of 1963)), 94 95, 98, 100, 102 to 106, 108 and 114 of the Act shall come into operation.

4.       The 26th day of October, 2001 is fixed as the day on which sections 63(1)(b), 64 and 99 of the Act shall come into operation.

5.       The 1st day of March, 2002 is fixed as the day on which sections 59, 60 and 61 subsections (1)(a) and (2) of section 63 and sections 65 and 84(a) of the Act shall come into operation.

EXPLANATORY NOTE

This Order provides that sections 47, 62, 66 to 71, 75 to 79, 80 to 83, 85 to 87, 89, 90, 91(b) 92, 93 (except in so far as it inserts subparagraph (ii) of paragraph (fa) into section 213 of the Companies Act, 1963 (No. 33 of 1963)), 94, 95, 98, 100, 102 to 106, 108 and 114 of the Company Law Enforcement Act will come into force on 1st. October, 2001.
