S.I. No. 353/2001 - Salmon and Sea Trout Caught by Rod and Line (Prohibition on Sale) Order, 2001


I, Frank Fahey, Minister for the Marine and Natural Resources, in exercise of the powers conferred on me by section 56 of the Fisheries Act, 1980 (No. 1 of 1980), as adapted by the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ), and the Marine (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 301 of 1997 ), make the following order:

1.        This Order may be cited as the Salmon and Sea Trout Caught by Rod and Line (Prohibition on Sale) Order, 2001.

2.        This Order shall come into operation on 1 August 2001.

3.        In this Order -

“annual period” means the period commencing on 1 January and ending on 31 October of each year;

“the Louth Area” has the meaning assigned to it by section 31 of the British-Irish Agreement Act, 1999 (No. 1 of 1999);

“the Moville Area” has the meaning assigned to it by section 2 of the Foyle Fisheries Act, 1952 (No. 5 of 1952);

“salmon” means a fish of the species Salmo salar (Atlantic salmon);

“sea trout” means the migratory form of Salmo trutta.

4.        A person shall not at any time during the annual period sell or offer for sale in the area to which this Order applies a salmon or a sea trout caught by rod and line.

5.        This Order shall apply throughout the State other than the Moville Area and the Louth Area.

This Order provides for a prohibition, from 1 January to 31 October in each year, on the sale of salmon or sea trout caught by rod and line. The Order applies throughout the seven fisheries regions of the State.
