S.I. No. 352/2001 - Diseases of Animals Acts, 1966 To 2001 (Approval and Registration of Dealers and Dealers' Premises) (Amendment) Order, 2001


I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by section 3 and section 29A (inserted by the Diseases of Animals (Amendment) Act, 2001 (No. 3 of 2001)) of the Diseases of Animals Act, 1966 (No. 6 of 1966) hereby order as follows:

1.   (1) This Order may be cited as the Diseases of Animals Acts 1966 to 2001 (Approval and Registration of Dealers and Dealers' Premises)(Amendment) Order, 2001.

(2) This Order shall come into operation on the 27 day of July, 2001.

2.   In this Order —

“Minister” means the Minister for Agriculture, Food and Rural Development.

“Principal Order” means the Diseases of Animals Acts, 1966 to 2001 (Approval and Registration of Dealers and Dealers' Premises) Order, 2001 ( S.I. No. 79 of 2001 ).

3.   Any person who immediately prior to the coming into operation of this Order is engaged in the buying and selling of animals or poultry, as a dealer, and to whom Article 6 (2) and/or Article 7 (2) of the Principal Order applies, shall forthwith, or in any event on or before 17 August 2001, apply to the Minister for approval and registration as a dealer and for approval and registration of his dealing premises if appropriate.

4.   Any person who complies with Article 3 of this Order may continue to engage in the buying and selling of animals or poultry, as a dealer, up to 31 October 2001 while awaiting the approval of the Minister.

5.   It shall not be lawful for any person to continue to engage in the buying or selling of animals or poultry, as a dealer, after 17 August, 2001 if that person has not complied with the requirements of Article 3 of this Order.

Explanatory Note

(This note is not part of the instrument and does not purport to be a legal interpretation).

This Order requires persons currently engaged in the buying and selling of animals and poultry, as a dealer, to apply on or before 17 August 2001 to be approved and registered as dealers and, if appropriate, to apply to have their dealing premises approved and registered. It also provides that persons who so apply may continue dealing in animals and poultry until 31 October, 2001 while awaiting formal approval and registration.

The Order makes it an offence for any person to continue to engage in the buying and selling of animals and poultry, as a dealer, after 17 August 2001 if the appropriate application for approval and registration has not been lodged by that date.
