S.I. No. 234/2001 - Air Pollution Act, 1987 (Environmental Specifications For Petrol and Diesel Fuels) (Amendment) Regulations, 2001


In exercise of the powers conferred on the Minister for the Environment and Local Government by sections 10 and 53 of the Air Pollution Act, 1987 (No. 6 of 1987), which said powers are delegated to me by the Environment and Local Government (Delegation of Ministerial Functions) (No.2) Order, 1997 ( S.I. No. 428 of 1997 ), and for the purpose of giving effect to Commission Directive 2000/71/EC (1 ) to adapt the measuring methods as laid down in Annexes I, II, III and IV to Directive 98/70/EC (2 ) of the European Parliament and of the Council to technical progress as foreseen in Article 10 of that Directive, I Dan Wallace, Minister of State at the Department of the Environment and Local Government, hereby make the following Regulations:-

Citation

1.       (1)      These Regulations may be cited as the Air Pollution Act, 1987 (Environmental Specifications for Petrol and Diesel Fuels) (Amendment) Regulations, 2001.

(2)      These Regulations, the Air Pollution Act, 1987 (Environmental Specifications for Petrol and Diesel Fuels) Regulations, 1999 ( S.I. No. 407 of 1999 ) and the Air Pollution Act, 1987 (Environmental Specifications for Petrol and Diesel Fuels) Regulations, 2000 ( S.I. No. 72 of 2000 ) shall be construed together as one and may be collectively cited as the Air Pollution Act, 1987 (Environmental Specifications for Petrol and Diesel Fuels) Regulations, 1999 - 2001.

Entry into Force

2.       These Regulations shall come into operation on 1 June, 2001.

Monitoring Compliance

3.       The following article is hereby substituted for article 12 of the Air Pollution Act, 1987 (Environmental Specifications for Petrol and Diesel Fuels) Regulations, 1999 ( S.I. No. 407 of 1999 ) :-

“12     (1)     Compliance with the environmental specifications for petrol set out in articles 5(1) and 7 shall be determined on the basis of the relevant analytical test methods set out in Annex I to Commission Directive 2000/71/EC.

(2)      Compliance with the environmental specifications for petrol set out in articles 5(2) and 5(3) shall be determined on the basis of the relevant analytical test methods set out in Annex III to Commission Directive 2000/71/EC.

(3)      Compliance with the environmental specifications for diesel fuel set out in articles 8(1) and 10 shall be determined on the basis of the relevant analytical test methods set out in Annex II to Commission Directive 2000/71/EC.

(3)      Compliance with the environmental specifications for diesel fuel set out in articles 8(2) and 8(3) shall be determined on the basis of the relevant analytical test methods set out in Annex IV to Commission Directive 2000/71/EC.”

EXPLANATORY NOTE

These Regulations amend the Air Pollution Act, 1987 (Environmental Specifications for Petrol and Diesel Fuels) Regulations, 1999 ( S.I. No. 407 of 1999 ) and transpose Commission Directive 2000/71/EC into Irish legislation.

The Regulations provide for the use of certain updated and adapted analytical test methods for monitoring compliance with the statutory environmental specifications for petrol and diesel fuels.
