S.I. No. 171/2001 - European Communities (Marketing of Compound Feedingstuffs) (Amendment) Regulations, 2001

I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purposes of giving effect to Council Directive 2000/16/EC of the 10 April 2000³¹ , and for the purposes of giving further effect to Council Directive No. 79/373 of 2 April 1979¹ as amended, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Marketing of Compound Feedingstuffs) (Amendment) Regulations, 2001.

(2) The European Communities (Marketing of Compound Feedingstuffs) Regulations, 1999 to 2000 and these Regulations may be cited collectively as the European Communities (Marketing of Compound Feedingstuffs) Regulations. 1999 to 2001.

(3) These Regulations shall come into operation on 1 May, 2001.

2. In these Regulations “the Directive” means Council Directive 79/373/EEC of 2 April, 1979¹ . 3. The European Communities (Marketing of Compound Feedingstuffs) Regulations. 1999, are hereby amended by:

(a) the amendment of Regulation 2 (1) as follows:-

the deletion of the definition “place on the market” and the insertion of the following definition

“putting into circulation” or “circulation” means-

the holding of compound feedingstuffs for the purposes of sale, including offering for sale, or any other form of transfer whether free or not, to third parties, and the sale and other forms of transfer themselves;

(b) the replacement of the term “place on the market” throughout the Regulation by the term “putting into circulation”;

the minimum storage life to be indicated in accordance with Article 5d of the Directive of 1979 (inserted by Article 1 (5) of Council Directive 90/44/EC of 22 January 1990¹¹ and amended by Article 1 (3) of Council Directive 2000/16/EC of 10 April 2000³¹ );

(d) the amendment of Regulation 6 (1) (m) as follows:

where appropriate, the approval number issued by the Minister in respect of the approved establishment or intermediary (within the meaning of the European Communities (Approval and Registration of Establishments and Intermediaries operating in the Animal Feed Sector) Regulations, 1999 ( S.I. No. 88 of 1999 )), concerned, or where appropriate, the registration number allocated to the establishment by the Minister in respect of an establishment or intermediary (within the meaning of the European Communities (Approval and Registration of Establishments and Intermediaries operating in the Animal Feed Sector) Regulations, 1999 ( S.I. No. 88 of 1999 )), concerned;

(e) the amendment of Regulation 8 (1) as follows:

8(1) A declaration referred to in Regulation 6 (1) (f) or Regulation 7 (1) (g) or a record under Regulation 11 shall specify all the feed materials of which the compound feedingstuff concerned consists and shall —

(a) in the case of a compound feedingstuff intended for animals other than pets list those feed materials in descending order according to their respective weights, or

(b) in the case of compound feedingstuff intended for pets

(i) specify the weight of each feed material, or

(ii) list those feed materials in descending order according to their respective weight.
