S.I. No. 37/2001 - Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 2001

The Government, in exercise of the powers conferred on them by -

(a) section 3A (inserted by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973) (“the Act of 1973”), as amended by section 6 , 8 and 9 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1983 (No. 32 of 1983) (the “Act of 1983”)), of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), and

(b) section 8A (inserted by section 11 of the Act of 1973, as amended by section 7 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977), and sections 6, 8 and 9 of the Act of 1983)), of the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938),

hereby order as follows:

1. This Order may be cited as the Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 2001.

2. In this Order -

“Act of 1938” means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

“Act of 1973” means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973);

“Act of 1977” means the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977);

“Act of 1996” the means Oireachtas (Miscellaneous Provisions) and Ministerial and Parliamentary Offices (Amendment) Act, 1996 (No. 39 of 1996).

3. (1) The annual sum by way of salary payable monthly under subsection (1) (inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), to each member of Dáil Éireann, with effect from 25 September 2000, shall be £41,143.

(2) The annual sum by way of salary payable monthly under subsection (1) (inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), to each member of Dáil Éireann, with effect from 1 March 2001, shall be £45,473.

4. (1) The annual sum by way of salary payable monthly under subsection (2) (inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 , to each member of Seanad Éireann, with effect from 25 September 2000, shall be £26,034.

(2) The annual sum by way of salary payable monthly under subsection (2) (inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 , to each member of Seanad Éireann, with effect from 1 March 2001, shall be £28,773.

5. (1) The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) or subsection (2) (inserted by the Act of 1977) of section 3 of the Act of 1938 shall be, with effect from 25 September 2000, a sum not exceeding -

(a) in the case of the Taoiseach - £79,146,

(b) in the case of the Tánaiste - £62,295,

(d) in the case of a Minister of State appointed under section 1 of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977) - £24,640.

(2) The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) or subsection (2) (inserted by the Act of 1977) of section 3 of the Act of 1938 shall be, with effect from 1 March 2001, a sum not exceeding -

(a) in the case of the Taoiseach - £87,475,

(b) in the case of the Tánaiste - £68,850,

(d) in the case of a Minister of State appointed under section 1 of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977) - £27,232.

6. (1) The annual sum by way of salary payable under section 4 (inserted by the Act of 1973) of the Act of 1938 to the Attorney General shall be, with effect from 25 September 2000, a sum not exceeding -

(a) in case the person who holds the office is not a member of either House of the Oireachtas - £95,998, and

(b) in case a member of either House of the Oireachtas holds the office - £54,855.

(2) The annual sum by way of salary payable under section 4 (inserted by the Act of 1973) of the Act of 1938 to the Attorney General shall be, with effect from 1 March 2001, a sum not exceeding -

(a) in case the person who holds the office is not a member of either House of the Oireachtas - £106,101, and

(b) in case a member of either House of the Oireachtas holds the office - £60,628.

7. (1) The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) of section 5 of the Act of 1938 shall be, with effect from 25 September 2000, a sum not exceeding -

(a) in the case of the Chairman of Dáil Éireann - £54,855, and

(b) in the case of the Deputy Chairman of Dáil Éireann - £24,640.

(2) The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) of section 5 of the Act of 1938 shall be, with effect from 1 March 2001, a sum not exceeding -

(a) in the case of the Chairman of Dáil Éireann - £60,628, and

(b) in the case of the Deputy Chairman of Dáil Éireann - £27,232.

8. (1) The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) of section 6 of the Act of 1938 shall be, with effect from 25 September 2000, a sum not exceeding -

(a) in the case of the Chairman of Seanad Éireann - £22,518, and

(b) in the case of the Deputy Chairman of Seanad Éireann - £12,227.

(2) The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) of section 6 of the Act of 1938 shall be, with effect from 1 March 2001, a sum not exceeding -

(a) in the case of the Chairman of Seanad Éireann - £24,889, and

(b) in the case of the Deputy Chairman of Seanad Éireann - £13,515.

9. The annual sum by way of allowance for expenses payable under section 10 (inserted by section 5 of the Act of 1996) of the Act of 1938 shall be, with effect from 25 September 2000, a sum not exceeding -

(a) where payable under subsection (1)(a) of the said section 10 - £35,530,

(b) where payable under subsection (1)(b) of the said section 10 - £28,424,

(d) where payable under subsection (1)(d) of the said section 10 - £7,231, and

(e) where payable under subsection (4) of the said section 10 - £14,210.

Explanatory Note

(This note is not part of the instrument and does not purport to be a legal interpretation).

This Order applies increases with effect from 25 September 2000 and 1 March 2001 to the salaries of members of the House of the Oireachtas, including Office Holders, arising from the recommendations in Report No. 38 of the Review Body on Higher Remuneration in the Public Sector, together with an increase in the sums payable to leaders of qualified parties and Independents in Dáil Éireann with effect from 25 September 2000. The increase with effect from 1 March 2001 takes account of a general pay increase on 1 October 2000 under the Programme for Prosperity and Fairness.
