S.I. No. 25/2001 - European Communities (Fresh Poultrymeat) (Amendment) Regulations, 2001


I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 91/494/EEC(1) of 26 June, 1991 as amended by Council Directive No. 93/121/EEC(2) of 22 December, 1993 and as last amended by Council Directive No. 1999/89/EC(3) of 15 November, 1999 hereby make the following Regulations:-

1.     (1)    These Regulations may be cited as the European Communities (Fresh Poultrymeat) (Amendment) Regulations, 2001.

(2)    These Regulations shall come into operation on the 12th of February, 2001.

(3)    The European Communities (Fresh Poultrymeat) Regulations, 1997 and these Regulations may be cited together as the European Communities (Fresh Poultrymeat) Regulations, 1997 and 2001.

2.     The European Communities (Fresh Poultrymeat) Regulations, 1997 are hereby amended as follows:

(a)    by the substitution in Regulation 3(1) for the definition of “the Council Directive” of the following:

“the Council Directive” means Council Directive No. 91/494/EEC(1) of 26 June, 1991, as amended by Council Directive No. 93/121/EEC(2) of 22 December 1993 and as last amended by Council Directive No. 1999/89/EC(3) of 15 November, 1999”.

(b)    by the deletion of Regulation 4 (1)(b), and

(c)    by the deletion of Regulation 4(1)(g).

4.     Regulation 10 of the European Communities (Fresh Poultrymeat) Regulations, 1996 ( S.I. No. 3 of 1996 ) as amended by the European Communities (Fresh Poultrymeat) Regulations, 1997 ( S.I. No. 125 of 1997 ) is hereby deleted.

3. The European Communities (Fresh Poultrymeat) Regulations, 1996 ( S.I. No. 3 of 1996 ) are hereby amended by the substitution for paragraph (1) (f) of Regulation 11 [ as inserted by Regulation 12 of the European Communities (Fresh Poultrymeat) Regulations, 1997 ] as follows:

“(f)   it is accompanied by a health certificate relating to the poultrymeat concerned in accordance with Article 12 of Council Directive 91/494/EEC, as amended by Council Directive No. 93/121/EEC of 22 December 1993 and as last amended by Council Directive No. 1999/89/EC of 15 November, 1999, supplemented, if necessary, by a declaration drawn up in accordance with Article 21 of Annex B to the Council Directive.”.

These Regulations implement Council Directive No. 1999/89 of 15 December, 1999 which amends Council Directive No. 91/494/EEC of 26 June 1991 as amended by Council Directive No. 93/121/EEC of 22 December 1993 on animal health conditions governing intra-Community trade in and imports from third countries of fresh poultrymeat.
