S.I. No. 278/1999 - Taxes Consolidation Act, 1997 (Designation of Airport Enterprise Area) Order, 1999.


I, CHARLIE Mc CREEVY, Minister for Finance, in exercise of the powers conferred on me by section 340 of the Taxes Consolidation Act, 1997 (No. 39 of 1997), and after consultation with the Minister for Public Enterprise, hereby direct as follows:

1. This Order may be cited as the Taxes Consolidation Act, 1997 (Designation of Airport Enterprise Area) Order, 1999.

2. In this Order “the Act” means the Taxes Consolidation Act, 1997 (No. 39 of 1997).

3. It is hereby directed that, the area described in Part II of the Schedule to this Order shall be a qualifying area for the purposes of Chapter 3 of the Act.

4. As respects the area, the definition of “qualifying period” contained in section 339(1) of the Act shall be construed as a reference to the period commencing on the 1st day of January, 1998 and ending on the 31st day of December, 1999.

SCHEDULE

PART I

In this Schedule:—

a reference to a line drawn along a driveway is a reference to a line drawn along the centre of that driveway.

a reference to the point where a driveway is intersected by the projection of a boundary is a reference to the point where a line drawn along the centre of the driveway would be intersected by the projection of such boundary.

PART II

Cork Airport Enterprise Area

That part of the administrative county of Cork in the town-land of Lehenagh More bounded by a line commencing at the point (hereafter in this description referred to as the first-mentioned point) at the South-Western corner of the field immediately north of the entrance driveway of Cork Airport known as Farmers Cross, and identified as 3.11 hectares on the Ordnance Survey Sheet No. 6469/B dated 31.12.1995, then continuing in an easterly direction along the southern boundary of the said field for a distance of 64 metres, then continuing in a straight undefined line in a northerly direction to the point where it intersects the mid-point of the southern boundary of the site identified as 1.15 hectares, then continuing, initially in a westerly direction along the said southern boundary and then in a northerly direction along the western boundary of the last mentioned site for a distance of 30 metres, then continuing, initially in a westerly direction along the northern boundaries of fields identified as 2.97 hectares, 5.70 hectares, 3.78 hectares and 2.25 hectares on the previously mentioned Ordnance Survey Sheet and the westerly projection of the last-mentioned field boundary to the point where it intersects the Cork Airport driveway, then continuing initially in a southerly direction and then in an easterly direction for a distance of 700 metres along the said driveway, then continuing due north in a straight undefined line to the point where it intersects the southerly boundary of the previously mentioned field identified as 5.70 hectares, then continuing in an easterly direction along the said southern boundary and the southern boundary of the adjoining field identified as 1.65 hectares to the first mentioned point.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order declares a certain area to be a qualifying regional airport enterprise area for the purpose of incentive tax reliefs provided for such areas under Chapter 3 of the Taxes Consolidation Act, 1997 . The Order also prescribes, in relation to the area, the qualifying period of the availability of the incentives for the area.
