CRIMINAL JUSTICE ACT, 1951 (SECTION 23) (DELEGATION OF POWERS) ORDER, 1998

The Government in exercise of the powers conferred on them by section 23A (inserted by section 17 of the Criminal Justice (Miscellaneous Provisions) Act, 1997 (No. 4 of 1997)) of the Criminal Justice Act, 1951 (No. 2 of 1951), hereby order as follows:

1. (1) This Order may be cited as the Criminal Justice Act, 1951 (Section 23) (Delegation of Powers) Order, 1998.

(2) This Order shall come into operation on the 20th day of October, 1998.

2. The powers conferred on the Government by section 23 of the Criminal Justice Act, 1951 (No. 2 of 1951), are hereby delegated to the Minister for Justice, Equality and Law Reform.

EXPLANATORY NOTE

This Order delegates the powers of the Government, except in capital cases, to commute or remit, in whole or in part, any punishment imposed by a Court exercising criminal jurisdiction and to remit, in whole or in part, any forfeiture or disqualification imposed by such a Court and restore or revive, in whole or in part, the subject of the forfeiture.
