S.I. No. 386 of 1998.

COUNTY BOROUGH OF DUBLIN LOCAL ELECTORAL AREAS ORDER, 1998

The Minister for the Environment and Local Government in exercise of the powers conferred on him by sections 3 and 24 of the Local Government Act, 1994 (No. 8 of 1994), hereby orders as follows:

1. This Order may be cited as the County Borough of Dublin Local Electoral Areas Order, 1998.

2. (1) The County Borough of Dublin shall be divided into the local electoral areas which are named in the first column of the Schedule to this Order.

(2) Each such local electoral area shall consist of the area set forth in the second column of the Schedule to this Order opposite the name of such local electoral area.

(3) The number of members of the council of the County Borough of Dublin to be elected for each such local electoral area shall be the number set forth in the third column of the Schedule to this Order opposite the name of that local electoral area.

(4) The number of said members to be elected for each such local electoral area who are to be aldermen shall be the number set forth in the fourth column of the Schedule to this Order opposite the name of that local electoral area.

3. Every reference in the Schedule to this Order to:

(1) the County Borough shall be construed as a reference to the County Borough of Dublin as existing at the date of this Order:

(2) a local electoral area shall be construed as a reference to such area as described in the County Borough of Dublin (Wards) Regulations, 1986 ( S.I. No. 12 of 1986 ), as amended by the County Borough of Dublin (Wards) (Amendment) Regulations, 1997 ( S.I. No. 43 of 1997 ) and therein referred to as wards.

4. (1) A reference in the Schedule to this Order to a line drawn along any road, avenue or street shall be construed as a reference to an imaginary line drawn along the centre of such road, avenue or street.

(2) A reference in the Schedule to this Order to the point at which any road, avenue or street intersects or joins any other road, avenue or street shall be construed as a reference to the point at which an imaginary line drawn along the centre of one would be intersected or joined by an imaginary line drawn along the centre of the other.

(3) A reference in the Schedule to this Order to a line drawn along a road which consists of a dual carriageway or motorway shall be construed as an imaginary line drawn along the central median of such dual carriageway or motorway.

5. The Dublin County Borough (Electoral Areas) Order, 1985 ( S.I. No. 134 of 1985 ) is hereby revoked.

EXPLANATORY NOTE

The effect of this Order is to amend the division of Dublin County Borough into local electoral areas, to fix the number of members to be elected for each electoral area and the number of aldermen to be elected for each electoral area.
