EUROPEAN COMMUNITIES (DEFINITION, DESCRIPTION AND PRESENTATION OF SPIRIT DRINKS) (AMENDMENT) REGULATIONS, 1998.

I, JOE WALSH, Minister for Agriculture and Food in exercise of the powers conferred on me by Section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purposes of giving full effect to Council Regulation (EEC) No. 1576/89 of 29 May 19891 and to Commission Regulation (EEC) No. 1014/90 of 24 April 19902 as amended in the manner specified in the definition of the "Council Regulation" as set out in Regulation 3 of these Regulations and to Commission Regulation (EC) No. 1434/97 of 23 July 19973 hereby make the following Regulations:—

1. (1) These Regulations may be cited as the European Communities (Definition, Description and Presentation of Spirit Drinks) (Amendment) Regulations, 1998.

(2) The European Communities (Definition, Description and Presentation of Spirit Drinks) Regulations, 1995 and 1996 and these Regulations may be cited together as the European Communities (Definition, Description and Presentation of Spirit Drinks) Regulations, 1995 to 1998.

2. In these Regulations "the Principal Regulations" means the European Communities (Definition, Description and Presentation of Spirit Drinks) Regulations, 1995 ( S.I. No. 300 of 1995 ).

3. Regulation 2 (1) of the Principal Regulations is hereby amended by the substitution for the definition of the "Council Regulation" of the following definition:

"The 'Council Regulation' means Council Regulation (EEC) No. 1576/89 of 29 May 1989 as amended by Council Regulation (EEC) No. 3280/92 of 9 November 1992 and Regulation (EC) no. 3378/94 of the European Parliament and of the Council of 22 December 1994 together with Commission Regulation (EEC) No. 1014/90 of 24 April 1990 as corrected by the Corrigenda published in the Official Journal No. L. 166/38 dated 20 June 1992 and amended by Commission Regulation (EEC) No. 1180/91 of 6 May 1991, Commission Regulation 1781/91 of 19 June 1991, Commission Regulation (EEC) No. 3458/92 of 30 November 1992, Commission Regulation (EC) No. 2675/94 of 3 November 1994 as corrected by Corrigenda published in the Official Journals No. L. 308/19 dated 2 December 1994 and No. L. 28/14 dated 7 February 1995, Commission Regulation (EC) No. 1712/95 of 13 July 1995, Commission Regulation (EC) No. 2626/95 of 10 November 1995 and Commission Regulation (EC) No. 2523/97 of 16 December, 1997 and Commission Regulation (EC) No. 1267/94 of 1 June 1994 as amended by Commission Regulation (EC) No. 1434/97 of 23 July 1997 ".

EXPLANATORY NOTE.

These Regulations amend the definition of the "Council Directive" contained in S.I. 300 of 1995 so as to include:

— Council Regulation (EEC) No. 3280/92 on the general rules relating to the definition, description and presentation of spirit drinks.

— Regulation No. 3378/94/EC on the prevention of the unlawful use of geographical designations of spirit drinks protected by a third country member of the World Trade Organisation,

— Commission Regulations 1180/91, 1781/91, 3458/92, 2675/95, 1712/95, 2626/95 and 2523/97 on the detailed rules relating to the definition, description and presentation of spirit drinks and

— Commission Regulation 1434/97 on the protection of the names of certain spirit drinks produced in the United Mexican States.
