S.I. No. 527/1997 - Harbour Rates (Dingle Harbour) Order, 1997.


I, MICHAEL WOODS, Minister for the Marine and Natural Resources, in exercise of the powers conferred on me by section 104 of the Harbours Acts, 1946 (No. 9 of 1946), the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ) and Marine (Alteration of Name and Department and Title of Minister) Order, 1997 ( S.I. No. 301 of 1997 , on the application of Dingle Harbour Commissioners and after due compliance with section 106 of the said Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Dingle Harbour) Order, 1997.

(2) This Order shall come into operation on the 18th day of December, 1997.

2. In this Order—

“week”, in relation to tonnage rates, means any period of seven consecutive days, or part thereof.

“an entry into the harbour”, in relation to a boat or vessel, means a stay by the boat or vessel in Dingle Harbour for a period of seven days or less.

“fish” has the same meaning as in the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959) as amended by the Fisheries (Amendment) Act, 1978 (No. 18 of 1978).

3. Where rates fixed under this Order are chargeable by reference to metric tonnage, weights of less than 1 metric tonne shall be chargeable as follows:

(a) any weight not exceeding 250 kilograms shall be charged as 250 kilograms.

(b) any weight exceeding 250 kilograms but not exceeding 500 kilograms shall be charged as 500 kilograms,

(c) any weight exceeding 500 kilograms but not exceeding 750 kilograms shall be charged as 750 kilograms,

(d) any weight exceeding 750 kilograms but not exceeding 1 metric tonne shall be charged as 1 metric tonne.

4. The Harbour Rates (Dingle Harbour) Order, 1993 ( S.I. No. 93 of 1993 ), is hereby revoked.

The tonnage of a Vessel upon which Tonnage Rates shall be based and chargeable mentioned at Reference Numbers 1 and 2 of this Schedule shall be the Net Register Tonnage or fifty per cent of the Gross Tonnage of the Vessel concerned whichever is greater.

Fishing Vessels laid up, vessels not licenced as fishing vessels or in use as pleasure craft, will be liable for the charges in 2 of First Schedule.

Vessels will be liable for Harbour Dues at annual rates on 1st October each year.

Boats with a permitted complement of between fifty and one hundred passengers

£37 per entry per boat or£2,500 +£20 per GRT per annum per boat payable in advance.

Boats with a permitted complement of over one hundred passengers

£50 per entry per boat or£4,000 +£20 per GRT per annum per boat payable in advance.

A compounded rate may be applied in agreement with Associations or Companies or groups of boat operators operating within the harbour. This rate can include above charges and additional charges for the provision of certain passenger facilities (e.g. pontoon and premises).

The compounded rate will be subject to approval by the Minister for the Marine and Natural Resources in accordance with section 100 of the Harbours Act, 1946 .

Pleasure Craft

Dingle Marina charges will apply to all pleasure craft berthing at the Town piers or Town Marina or mooring inside the breakwaters. Rates to be fixed annually by Dingle Harbour Commissioners in accordance with Section 55 of Harbours Act, 1946 .

Marina charges for pleasure craft will include Harbour Dues.

Notes

1. Herring and Mackerel. A consolidated charge will be levied on fishing vessels and landings of Herring or Mackerel. This charge will be levied on vessel landing fish or fish seller and will be instead of single entry rates.

An initial entry charge of£90 per vessel for the herring/mackerel season and a landing charge of£2 per ton of herring/mackerel landed will apply. Vessels paying annual charge will not be liable for entry charge but will be liable for landing charge.

2. An ad valorem rate (in lieu of goods and tonnage rates) of 1.25% of value of fish landed, may apply for all fishing vessels landing at Dingle.

The ad valorem rate may be applied at the discretion of Dingle Harbour Commissioners and with the consent of the Minister for the Marine and Natural Resources.

THIRD SCHEDULE

Moorings

All moorings laid in the harbour will be at the discretion of the harbour master and will be registered and recorded on a chart of the harbour. An annual charge of£50 in addition to harbour dues will apply to each mooring.

Water

Water may be charged for at a rate which includes service charges. Water charge per tonne — 72 pence.

Minimum water charge of£10 may be charged each time water is provided outside staff normal working hours.

Electricity

As per coin metered charge.

Designated Ice and Landing Berths

An additional charge of£50 per day will apply to vessels occupying designated ice or landing berths, or overstaying in these berths, without the permission of the Harbour Master, for purposes other than immediate landing of fish or cargo, or taking on ice on board.

Slipways

A charge of£30 per day for every day in excess of three days will apply to vessels occupying any slipway.

Launching Charge

A launching charge of£2.50 per launching may be applied by Dingle Harbour Commissioners for vessels launched from harbour slipways.

Storage

A charge of£4 per linear Metre per week for boat trailers and£1 per cubic metre per week for other items will apply to goods stored on quay walls and harbour property.

Note: Goods improperly stored or causing an obstruction or not approved by Dingle Harbour Commissioners will be removed at the expense of the owner. Dingle Harbour Commissioners or their servants may undertake removal of goods or gear not properly stored and charge the cost of removal to the owners. Dingle Harbour Commissioners and their servants will not be responsible for damage to stored items or damage incurred in moving stored items.

Winter Hard Stand will be charged at£9 per metre September to May.

A charge of£5 per metre per week will be charged on vessels overstaying on hard stand after 1 May each year.

Fuel

1. An annual charge will apply for the use of fuel storage and delivery facilities (pipelines) at the harbour. This charge to be agreed between Dingle Harbour Commissioners and the lessee of the facility.

2. All deliveries of fuel other than those covered in 1 above will be subject to a levy of 0.3 pence per litre payable by the fuel supplier or their agent. The onus will be on the fuel supplier, to verify delivery figures to the satisfaction of Dingle Harbour Commissioners. Dingle Harbour Commissioners may require deliveries to be notified to the Harbour Master in advance of delivery in order to verify quantities.

Parking

Dingle Harbour Commissioners may designate certain areas for parking and apply charges for the use of these areas for parking. Rates to be fixed annually by Dingle Harbour Commissioners in accordance with Section 55 of Harbours Act, 1946 .
