EUROPEAN COMMUNITIES (FEES FOR HEALTH INSPECTIONS AND CONTROLS OF FRESH MEAT) (AMENDMENT) REGULATIONS, 1997.

 I, IVAN YATES, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Directive 93/118/EEC of 22 December 19931 hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Fees for Health Inspections and Controls of Fresh Meat) (Amendment) Regulations, 1997.

2. The European Communities (Fees for Health Inspections and Controls of Fresh Meat) Regulations, 1995 ( S.I. No. 34 of 1995 are hereby amended by the insertion of the following regulation:

  "4A (1) Subject to the provisions of Council Directive 85/85/73 EEC of 29 January 19852 (as amendment by Council Directive 93/118/EEC of 22 December 1993), the Minister may enter into an agreement with the occupier of premises providing for the recovery by the Minister of the real inspection costs incurred in relation to those premises.

  (2) An agreement referred to in paragraph (1) may provide for the giving of security, of such a nature as may be specified in the agreement, by the occupier of premises to the Minister in respect of the real inspection cost relating to those premises".

EXPLANATORY NOTE.

These Regulations amends S.I. No. 34 of 1995 with effect from 15 May 1997 giving a legal basis for the requirement of a contract and bond in relation to providing a Meat Inspection service.
