EUROPEAN COMMUNITIES (INTRODUCTION OF ORGANISMS HARMFUL TO PLANTS OR PLANT PRODUCTS) (PROHIBITION) (AMENDMENT) REGULATIONS, 1997.

 I, IVAN YATES, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by Section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purposes of giving effect to Commission Decision No. 96/301/EC of 3 May 1996⁽¹⁾, Commission Directive 96/76/EC of 29 November 1996⁽²⁾ and Commission Directive 96/78/EC of 6 December 1996⁽³⁾ hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) (Amendment) Regulations, 1997.

(2) The European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) Regulations 1980 to 1996 and these Regulations may be cited together as the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) Regulations 1980 to 1997.

2. In these Regulations "the Principal Regulations" means the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) Regulations, 1980 ( S.I. No. 125 of 1980 ).

3. Regulation 2 of the Principal Regulations is hereby amended by the substitution in paragraph (1) in the definition of "the Directive" for "and Commission Directive 96/15/EC of 14 March 1996." (inserted by the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) (Amendment) (No. 2) Regulations, 1996 ( S.I. No. 266 of 1996 )) of ", Commission Directive 96/76/EC of 29 November 1996 and Commission Directive 96/78/EC of 6 December 1996."

4. Regulation 11 of the Principal Regulations is hereby amended by the substitution for Paragraph (2A) (inserted by Regulation 4 of the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) (Amendment) Regulations, 1992 ( S.I. No. 214 of 1992 )) of the following paragraph:

"(2A) ( a ) A person shall not introduce into the State or move within the State, tubers of solanum tuberosum L., other than those intended for planting, originating in Egypt unless they comply with the conditions of Article I of Commission Decision No. 96/301/EC of 3 May 1996.

( b ) The requirements of this paragraph are in addition to and not in substitution for the requirements of paragraph (1) and (2) of this Regulation."

EXPLANATORY NOTE.

These Regulations

— Amend the Annexes to Council Directive 77/93/EEC to provide for protective measures against the introduction into the Community of an organism harmful to wheat and rye, Tilletia indica Mitra (Karnal Bunt)

— Implement the provisions of Commission Directive 96/76/EC on the recognition of Austria, Finland and Sweden as Protected Zones of the Community and

— Implement Commission Decision 96/301/EC which adjusts existing conditions relating to the introduction of ware potatoes from Egypt.
