MARINE (DELEGATION OF MINISTERIAL FUNCTIONS) ORDER, 1997.

The Government, on the request of the Minister for the Marine and in exercise of the powers conferred by section 2 (1) of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977), hereby order as follows:

1. This Order may be cited as the Marine (Delegation of Ministerial Functions) Order, 1997.

2. The powers and duties of the Minister for the Marine conferred on the Minister by or under the enactments specified in the Schedule to this Order are hereby delegated to EAMON GILMORE, Minister of State at the Department of the Marine.

3. The Marine (Delegation of Ministerial Functions) (No. 2) Order, 1995 ( S.I. No. 199 of 1995 ), is hereby revoked.

SCHEDULE

Dumping at Sea Act, 1996 (No. 14 of 1996);

Dún Laoghaire Harbour Acts, 1990 and 1994;

Fisheries Acts, 1959 to 1995, in so far as they relate to inland

fisheries, aquaculture and the marine environment;

Foreshore Acts, 1933 and 1992;

Free Ports Act, 1986 (No. 6 of 1986), in so far as it relates

to port development;

Harbours (Regulation of Rates) Act, 1934 (No. 2 of 1934), in so far as it relates to port development;

Harbours Acts, 1946 to 1976, in so far as they relate to port development;

Harbours Act, 1996 (No. 11 of 1996), in so far as it relates to port development;

Marine Institute Act, 1991 (No. 2 of 1991);

Oil Pollution of the Sea (Civil Liability and Compensation) Act, 1988 (No. 11 of 1988);

Pilotage Act, 1913, in so far as it relates to port development;

Sea Pollution Act, 1991 (No. 27 of 1991).

EXPLANATORY NOTE.

This Order delegates to Earnon Gilmore, T.D. Minister of State at the Department of the Marine, the powers and duties of the Minister for the Marine under the Acts specified in the Schedule to this Order.
