EUROPEAN COMMUNITIES (VEGETABLE SEEDS) (AMENDMENT) REGULATIONS, 1997.

 I, IVAN YATES, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive 96/18/EC of 19 March 19961 and Council Directive 96/72/EC of 18 November 19962 in so far as they relate to vegetable seeds, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Vegetable Seeds) (Amendment) Regulations, 1997 and shall come into operation on the 3rd day of February 1997.

(2) The European Communities (Vegetable Seeds) Regulations, 1981 to 1991 and these Regulations may be cited together as the European Communities (Vegetable Seeds) Regulations, 1981 to 1997 and shall be construed together as one.

2. In these Regulations—

"the Principal Regulations" means the European Communities (Vegetable Seeds) Regulations, 1981 ( S.I. No. 73 of 1981 ).

3. Regulation 2 of the Principal Regulations is hereby amended in paragraph (2) by the insertion after "15 December 1988" of "Commission Directive 96/18/EC of 19 March 1996 and Council Directive 96/72/EC of 18 November 1996".

4. The Schedule to the Principal Regulations, as amended by the European Communities (Vegetable Seeds) (Amendment) Regulations, 1991 ( S.I. No. 107 of 1991 ), is hereby amended—

( a ) in Annex III

(i) by the substitution of the following paragraph for paragraph 1:

'1. Maximum weight of a seed lot:

( a ) seeds of Phaseolus vulgaris, Pisum sativum and Vicia faba

25 tonnes;

( b ) seeds of a size not less than a grain of wheat, other than Phaseolus vulgaris, Pisum sativum and Vicia faba

20 tonnes;

( c ) seeds of a size smaller than a grain of wheat

10 tonnes.

The maximum lot weight shall not be exceeded by more than 5 per cent.'

( b ) in Annex IV

(i) paragraph A(a)1:

(I) by the substitution of "EC" for "EEC",

and

(ii) paragraph B(a)1:

(I) by the substitution of "EC" for "EEC".

EXPLANATORY NOTE.

This Regulation replaces the abbreviation "EEC" with "EC" with regard to packaging and labelling of seeds. The maximum weights for seed lots of certain species have also been revised.
