VIDEO RECORDINGS ACT, 1989 (SUPPLY CERTIFICATE AND LABELLING) (AMENDMENT) REGULATIONS, 1996

I, AUSTIN CURRIE, Minister of State at the Department of Justice, in exercise of the powers conferred on me by sections 12 and 31 of the Video Recordings Act, 1989 (No. 22 of 1989), and the Justice (Delegation of Ministerial Functions) Order, 1995 ( S.I. No. 13 of 1995 ), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Video Recordings Act, 1989 (Supply Certificate and Labelling) (Amendment) Regulations, 1996.

(2) The Video Recordings Act, 1989 (Supply Certificate and Labelling) Regulations, 1994 ( S.I. No. 134 of 1994 ), and these Regulations may be cited together as the Video Recordings Act, 1989 (Supply Certificate and Labelling) Regulations, 1994 and 1996 and shall be construed together as one.

2. These Regulations shall come into operation on the 1st day of January, 1997.

3. In these Regulations, the "Regulations of 1994" means the Video Recordings Act, 1989 (Supply Certificate and Labelling) Regulations, 1994.

4. Regulation 2(2) of the Regulations of 1994 is hereby amended by-

( a ) the substitution of the following paragraph for paragraph (b):

(b) relation to a supply certificate which includes a statement indicating that the video work in respect of which it was granted is, in accordance with section 4(1)(b) of the Act, fit for viewing by persons generally but, in the case of a child under the age of 12 years, only under parental guidance, the capital letters "PG", not less than 5 millimetres in height, in 100 per cent. process blue and set on a white background in a 50 per cent. process blue eight-sided figure which contains the words "Film Censor's Office" and "Oifig Scrúdóir na Scannán"" and

( b ) the insertion of the following paragraph after paragraph (b):

"(bb) in relation to a supply certificate which includes a statement indicating that the video work in respect of which it was granted is, in accordance with section 4(1 )(bb) (as inserted by the Video Recordings Act, 1989 (Classification of Video Works) Regulations 1996 ( S.I. No. 403 of 1996 )) of the Act, fit for viewing by persons ' aged 12 years or more, the number "12", not less than 5 millimetres in height, in white and set on a 100 per cent. process blue background in a 50 per cent. process blue eight-sided figure which contains the words "Film Censor's Office" and "Oifig Scrúdóir na Scannán":".

5. The Regulations of 1994 are hereby amended by the substitution of the following Schedule for the Schedule thereto:

EXPLANATORY NOTE

These Regulations provide for changes in relation to the labels and labelling of video recordings. The changes are necessitated by an amendment to the Video Recordings Act, 1989 which has been made by the Video Recordings Act, 1989 (Classification of Video Works) Regulations, 1996. The changes to video classifications are: (a) substitution of the words "under parental guidance" for the words "in the company of a responsible adult" in the classification "fit for viewing generally, but in the case of a child under 12 years, only in the company of a responsible adult"; and (b) introduction of an additional classification of "fit for viewing by persons aged 12 years or more". Because of these changes, two new symbols are prescribed by the present Regulations for use on classification labels. A Schedule to the 1994 Regulations has also been replaced by a new Schedule containing both the two new symbols as well as those symbols which are unchanged.
