ENERGY (MISCELLANEOUS PROVISIONS) ACT, 1995 (SECTION 14) ORDER, 1996

I, Michael Lowry, T.D., Minister for Transport, Energy and Communications, in exercise of the powers conferred on me by section 14 of the Energy (Miscellaneous Provisions) Act, 1995 (No. 35 of 1995), hereby make the following order:

1.—This Order may be cited as the Energy (Miscellaneous Provisions) Act, 1995 (Section 14) Order, 1996.

2.—All the fee simple interest of the Dublin Gas Company in the land described in the Schedule to this Order shall, on the 16th day of September, 1996, vest in Bord Gáis Éireann in fee simple subject to and with the benefit of a lease dated 23rd day of January, 1871, between Henry N. Courtney of the One Part and the Alliance and Dublin Consumers Gas Company of the Other Part, for a term of 200 years from the 25th day of March, 1870, subject to the yearly rent of £158.80, thereby reserved and to the covenants and conditions therein contained.

SCHEDULE

ALL THAT AND THOSE the property demised by a Lease dated the 23rd day of January, 1871, and made between Henry Nicholas Courtney of the One Part and Alliance and Dublin Consumers Gas Company of the Other Part and therein described as "ALL THAT AND THOSE that lot of ground lying between Barrow Street and the South Lotts road at the North side of the Dublin and Kingstown Railway containing in breadth in front to Barrow Street Five hundred feet and in breadth in the rere to South Lotts road the like number of feet and depth from front to rere Seven hundred and ninety four feet or thereabouts be the said admeasurements or any of them more or less with the right to the said Company to sink and quarry to such depth as may be necessary to secure proper foundations for the Gas holders to be erected on said demised lands and to carry away and dispose of any surplus stones which may not be required in the erection of the said Gas holders the northern boundary of the said lot being parallel with the said Railway which said demised premises are bounded in the South by the said Railway on the West by Barrow Street on the East by South Lotts road and on the North by other ground the property of Henry Nicholas Courtney let to Joseph Mulholland for a Ropewalk and more particularly delineated and described in a Map or Terchart endorsed on these presents and are situate lying and being in the Parish of Saint Mark in the County of Dublin" which said property is now situate in the City of Dublin.

EXPLANATORY NOTE

This Order provides that the assets of a property in Barrow Street, Dublin, which was owned by Dublin Gas Company (in receivership), be vested in Bord Gais Eireann.
