DUN LAOGHAIRE HARBOUR RATES ORDER, 1995.

I, SEAN BARRETT, Minister for the Marine, in exercise of the powers conferred on me by Section 8 of the Dun Laoghaire Harbour Act, 1990 , (No. 7 of 1990), hereby order as follows:

1. ( a ) This order may be cited as the Dun Laoghaire Harbour Rates Order, 1995.

( b ) This Order shall come into operation on the 1st day of December 1995.

2. In this Order "the Harbour" means Dun Laoghaire Harbour (which includes an area within 500 yards from the mouth of the Harbour).

3. In respect of vessels entering the Harbour the Tonnage/Entry Rates set forth in Schedule I to the order are hereby fixed as the maximum rates chargeable in respect of Dun Laoghaire Harbour.

4. The tonnage of a vessel upon which tonnage rates shall be based and chargeable shall be the net registered tonnage or half the gross tonnage, whichever is the greater.

5. The Goods Rates set forth in the Schedule II to this order are hereby fixed as the maximum rates chargeable in respect of Dun Laoghaire Harbour for the gross weight of goods and merchandise shipped, transhipped or unshipped in the Harbour.

6. Goods Rates shall not be charged in respect of the outfits, stores or provisions of any vessel.

7. Not withstanding the provisions of this order the Minister may enter into Port Operating Agreements with shipping operators or their agents where such an agreement is considered necessary for the development/operation of the Harbour.

8. The Dun Laoghaire Harbour Rates Order, 1992 ( S.I. No. 108 of 1992 ) is hereby revoked.

SCHEDULE I

MAXIMUM TONNAGE RATES

1.	For a commercial trading vessel, other than provided for elsewhere in this Schedule, per tonne	94p
2.	For a vessel which is engaged mainly in the trade of carrying passengers and motor cars accompanied by their owners as passengers and which ships and unships vehicles and/or cargo by a roll-on/roll-off system, per entry	£1,055.00
3.	For a vessel as at (2) above with a capacity to carry no more than 150 motor cars, per entry	£527.50
4.	For a vessel, other than a commercial fishing vessel, which enters the Harbour for a non-trading purpose such as for repairs or through stress of weather or for bunker or stores for the vessel's own consumption and does not take on board any cargo or passengers or discharge cargo or disembark passengers (except temporarily in connection with the repairs to the vessel), per tonne	26.51p
5.	For a fishing vessel, per entry Alternative annual composition rate, valid for the period from the date of payment to the following 31 December	£2.64 £65.89
6.	For a vessel remaining in the Harbour for more than six weeks, for every week it shall so remain in the Harbour after six weeks, per tonne	1.16p
7.	For a vessel entering or leaving the Harbour for the purpose of conveying passengers or cargo to or from a vessel anchored outside the Harbour, per tonne On payment on any day of a composition rate equivalent to the rate for two such trips a vessel may make an unlimited number of trips during that day without further payment	1.81p
8.	For a cruise liner, per tonne	22p
9.	For a vessel which is engaged exclusively in the trade of carrying cargo laden vehicles and road vehicles and which ships and unships such vehicles by a roll-on/roll-off system, per tonne	59.33p
10.	For a vessel engaged in angling trips, per day	£5.00
	Alternative monthly composition rate valid for the period from the date of payment to the end of the calendar month	£50.00
