MERCHANT SHIPPING (LIGHT DUES) ORDER, 1995.

I, HUGH COVENEY, Minister for the Marine, in exercise of the powers conferred on me by section 2 of the Merchant Shipping (Light Dues) Act, 1983 (No. 18 of 1983), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), hereby order as follows:

1. (1) This Order may be cited as the Merchant Shipping (Light Dues) Order, 1995.

(2) This Order shall come into operation on the 1st day of April, 1995.

2. The Second Schedule (inserted by the Merchant Shipping (Light Dues) Order, 1991 ( S.I. No. 90 of 1991 ), and amended by the Merchant Shipping (Light Dues) (No. 2) Order, 1991 ( S.I. No. 229 of 1991 ) and by the Merchant Shipping (Light Dues) Order, 1992 ( S.I. No. 60 of 1992 )) to the Merchant Shipping (Mercantile Marine Fund) Act, 1898, is hereby amended—

( a ) by the substitution of the following subparagraph for subparagraph (1) of paragraph 1 of Part I:

"(1) Subject to a minimum charge of £66 per voyage and to paragraph 1 (2) below, there shall be the following charges per voyage:

( a ) Ships, other than Ro/Ro ferries, not liable to periodical payments:

46 pence per ton;

( b ) Ro/Ro ferries:

(i) in respect of which there is an International Tonnage Certificate (1969) in force:

46 pence per ton;

(ii) in respect of which there is no International Tonnage Certificate (1969) in force:

46 pence per ton on the first 1,000 tons, plus

91 pence per ton on any excess over 1,000 tons.";

( b ) by the insertion of the following subparagraph after subparagraph (f) of paragraph 5 of Part II:

"( g ) 'International Tonnage Certificate (1969)' means a certificate issued under the provisions of the International Convention on Tonnage Measurement of Ships, 1969, done at London on the 23rd day of June, 1969.".

EXPLANATORY NOTE.

This Order amends the Merchant Shipping (Light Dues) Order, 1991 to remove the surcharge applied to Ro/Ro ferries in respect of vessels which hold a valid International Tonnage Certificate (1969).
