SOCIAL WELFARE (OVERLAPPING BENEFITS) (AMENDMENTS) REGULATIONS, 1994.

The Minister for Social Welfare in exercise of the powers conferred on him by sections 4 and 209 of the Social Welfare (Consolidation) Act, 1993 (No. 27 of 1993), hereby makes the following Regulations:—

1 Citation and construction.

1. (1) These Regulations may be cited as the Social Welfare (Overlapping Benefits) (Amendment) Regulations, 1994.

(2) These Regulations and the Social Welfare (Overlapping Benefits) Regulations, 1991 shall be construed together as one and may be cited together as the Social Welfare (Overlapping Benefits) Regulations 1991 to 1994.

2 Commencement.

2. These Regulations shall come into operation on the 28th day of October, 1994.

3 Amendment of Principal Regulations.

3. The Social Welfare (Overlapping Benefits) Regulations, 1991 ( S.I. No. 281 of 1991 ) are hereby amended by—

( a ) the substitution of "survivor's pension" for "widow's (contributory) pension" in each place where those words occur;

( b ) the deletion in article 7 (6) of paragraph (d); and

( c ) the deletion in paragraph (a) of article 8 (2) of ", survivor's benefit under section 87 of the Act".

EXPLANATORY NOTE.

These Regulations provide for a number of consequential amendments arising from the introduction of Survivor's Pension and extend the existing provisions which apply to widows in receipt of Widow's (Contributory) Pension to both widows and widowers who receive Survivor's Pension.
