ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF WESTMEATH) REGULATIONS 1994.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Westmeath) Regulations, 1994.

2 Commencement.

2. These Regulations shall come into operation on the 18th day of July, 1994.

3 Interpretation.

3. In these Regulations save where the context otherwise requires—

"the Act" means the Road Traffic Act, 1961 ;

"road" means a public road;

"National Road" means a road declared to be a National Road in the Local Government (Roads and Motorways) Act 1974 (Declaration of National Roads Order 1977) ( S.I. No. 164 of 1977 ) and any reference to the number of such road as shown in column 1 of the First Schedule or column 1 of the Second Schedule to the aforementioned Order.

"perimeter road" means a road on and along the roadway of which there runs the boundary of a borough or urban district or a town and shall be considered as being within such boundary for the purpose of these Regulations;

"special speed limit" and "built up area speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochana, in the performance of their duties as such members.

7. The Road Traffic (Speed Limits) (County of Wesmeath) Regulations, 1981 (S.I. No. 365 of 1981) are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Athlone:—

( a ) The Doovoge Road, the Carrick-o-Brien Road.

( b ) The Clonown Road for a distance of 489 metres north of the urban district boundary.

( c ) The Golden Island Road for a distance of 270 metres north of the urban district boundary.

2. The following roads in the town of Mullingar:—

( a ) The Castlepollard Road between the point where the town boundary intersects the eastern side of the road and a point 296 metres north east of its junction with the Longford Road (National Road N4).

( b ) The Kilbeggan Road (National Road N52) between the town boundary and a point 285 metres south of its junction with the Lynn Industrial Estate Road.

( c ) The Dublin Road (National Road N4) between the town boundary and a point 174 metres west of its junction with Glenview Housing Estate Road.

( d ) Ashe Road between the town boundary and a point 266 metres north west of its junction with O'Growney Terrace.

( e ) The Athlone Road between the town boundary and a point 52 metres west of its junction with Grange Housing Estate Road.

( f ) Clonmore Industrial Estate Road between the point where the town boundary intersects the northern side of the road and a point 416 metres west of its junction with Burke's Road.

SECOND SCHEDULE.

Roads declared to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following roads adjacent to the Urban District of Athlone:—

( a ) The Ballymahon Road (National Road N55) between the urban district boundary and a point 14 metres north-east of its junction with the Mayfield Grove Housing Estate entrance road.

( b ) The One-Mile Round Road, the Old Ballymahon Road, Sli-on-Aifrinn, Arcadia Court, Arcadia Crescent, Whitebeam Avenue, Abbey Cottages Road.

( c ) Bloomfield Drive Housing Estate Roads, Mayfield Grove Housing Estate Road, Clonbrusk Housing Estate Roads, Maple Court Housing Estate Road, Tormey Villas Housing Estate Roads, Cloghanboy (Homan) Housing Estate Road, the Pines.

( d ) The road serving the ex-servicemen's houses at Cloghanboy.

( g ) The Off-Ramp from the west-bound carriageway of the Athlone Relief Road at the Ballymahon Interchange for a distance of 37 metres east of its junction with the New Ballymahon Road (National Road N55).

( h ) The Off-Ramp from the east-bound carriageway of the Athlone Relief Road at the Ballymahon Interchange for a distance of 38 metres west of its junction with the New Ballymahon Road (National Road N55).

( i ) The road connecting the New Ballymahon Road (National Road N52) and the Old Ballymahon Road.

( c ) The Cornamagh Road for a distance of 50 metres of its junction with the Ballymahon Road (National Road N55).

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) County of Westmeath Regulations, 1981 (S.I. No. 365 of 1981), and alter the speed limits applicable to certain roads in County Westmeath.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 and declare the roads mentioned in the Second Schedule, to be subject to that limit.

The Regulations also prescribed a speed limit of 40 mph in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are exempt from the speed limits prescribed by the Regulations.
