INDUSTRIAL TRAINING (DESIGNATION OF SECTORS OF INDUSTRY) ORDER, 1994.

The Minister for Enterprise and Employment, after consultation with An Foras Áiseanna Saothair (An Foras) and with organisations and associations of organisations appearing to him to be representative of substantial numbers of employers in the industrial activities referred to in this order and of substantial numbers of persons employed in such activities, hereby, in exercise of the powers conferred on him by section 3 of the Industrial Training (Apprenticeship Levy) Act, 1994 (No. 3 of 1994), makes the following order with respect to which, pursuant to section 3 (5) of that Act, a draft of the order, with the approval of the Minister for Finance, has been laid before each House of the Oireachtas and a resolution approving of the draft has been passed by each such House:

1. This order may be cited as the Industrial Training (Designation of Sectors of Industry) Order, 1994.

2. the Activities specified in the Schedule to this order, which have been declared to be designated industrial activities for the purposes of the Industrial Training Act, 1967 (No. 5 of 1967), are hereby declared to be designated sectors of industry for the purposes of the Industrial Training (Apprenticeship Levy) Act, 1994 (No. 3 of 1994).

SCHEDULE

1. The following activities of industry are the activities referred to in Article 2 of this order, namely:—

the activities referred to in the Schedules of each of the following orders:—

—The Industrial Training (Engineering Industry) Order, 1969 ( S.I. No. 40 of 1969 );

—The Industrial Training (Construction Industry) Order, 1969 ( S.I. No. 47 of 1969 );

—The Industrial Training (Printing and Paper) Order, 1970 ( S.I. No. 21 of 1970 ).

2. Paragraph 1 of this Schedule shall be construed as not including:—

Establishments regarded by An Foras as manufacturing and service establishments wholly or mainly engaged in a variety of activities, from telecommunications and computers to process control with one thing in common which is that they wholly or substantially share a common technology which is largely semi-conductor/microprocessor based.

3. In respect of Local Authorities, Article 2 of this order will apply only to the construction activities (as defined in S.I. No. 47 of 1969 ) of Local Authorities.

EXPLANATORY NOTE.

The Industrial Training (Apprenticeship Levy) Act, 1994 , provides for levy on employers, in certain sectors of industry to partly fund a new apprenticeship scheme to be run by An Foras Áiseanna Saothair. This order defines these sectors of industry.
