EUROPEAN COMMUNITIES (CEREAL SEED) (AMENDMENT) REGULATIONS, 1993.

I, JOE WALSH, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive No. 88/506/EEC of 13th September, 1988(1), Commission Directive No. 90/623/EEC of 7th November, 1990(2) and Commission Directive No. 93/2/EEC of 28th January, 1993(3), hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Cereal Seed) (Amendment) Regulations, 1993, and shall come into operation on the 18th day of May, 1993.

(2) The European Communities (Cereal Seed) Regulations, 1981 to 1992, and these Regulations may be cited together as the European Communities (Cereal Seed) Regulations, 1981 to 1993, and shall be construed together as one.

2. In these Regulations—

"the Principal Regulations" means the European Communities (Cereal Seed) Regulations, 1981 ( S.I. No. 48 of 1981 ).

3. Regulation 2 (4) of the Principal Regulations (which specifies the Directives, Act and Decisions which have amended Council Directive No. 66/402/EEC of 14th June, 1966(4)) shall be construed as if there were included therein reference to Commission Directive No. 88/506/EEC of 13th September, 1988, Commission Directive No. 90/623/EEC of 7 November, 1990 and Commission Directive No. 93/2/EEC of 28th January, 1993.

4. Annex II of the Schedule to the Principal Regulations is hereby amended:

( a ) by the insertion in column 2 of the table to paragraph 2A of the reference "(d)" after the figure 85 shown in respect of certified seed 1st and 2nd generation of the species Avena sativa and others,

and

( b ) by the insertion in paragraph 2B of the following subparagraph:

"( d ) in the case of varieties of Avena sativa which are officially classified as of the 'naked oat' type the minimum germination capacity is reduced to 75 per cent of pure seed. In such a case the official label shall be endorsed 'minimum germination capacity 75 per cent'".

EXPLANATORY NOTE.

These Regulations, by amending existing Regulations on the marketing of cereal seed, allow for a minimum germination capacity of 75 per cent in the case of varieties of Avena sativa which are officially classified as of the 'naked oat' type.
