S.I. No. 27/1993 - Garda Síochána (Promotion) (Amendment) Regulations, 1993.


I, MÁIRE GEOGHEGAN-QUINN, Minister for Justice, in exercise of the powers conferred on me by section 14 (1) (b) of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and with the approval of the Government, hereby make the following regulations:

1. (1) These Regulations may be cited as the Garda Síochána (Promotion) (Amendment) Regulations, 1993.

(2) These Regulations shall come into operation on the 27th day of January, 1993.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations "the Principal Regulations" means the Garda Síochána (Promotion) Regulations, 1987 ( S.I. No. 39 of 1987 ).

4. Regulation 3 of the Principal Regulations is hereby amended by the insertion of the following definitions:

"'regional interview board' means an interview board held in such areas as the Commissioner, with the consent of the Minister and the Council, may determine to interview members serving in the areas concerned who are candidates at a competition held by an interview board for promotion to the rank of sergeant or inspector;

'central interview board' means an interview board held to interview those candidates who are successful at an interview held at a regional interview board.".

5. Regulation 5 of the Principal Regulations is hereby amended by the substitution for paragraph (1) of the following paragraph:

"(1) Subject to these Regulations—

( a ) the selection of members for promotion to the rank of superintendent or chief superintendent shall be made by means of a competition held by an interview board which shall include an interview with each candidate in the competition, and

( b ) the selection of members for promotion to the rank of sergeant or inspector shall be made by means of a competition held by an interview board which shall include an interview with each candidate in the competition at a regional interview board followed by interviews with successful candidates at a central interview board.".

6. Regulation 5 of the Principal Regulations is hereby further amended by the substitution for paragraph (5) of the following paragraph:

"(5) Subject to paragraph (6) of this Regulation—

( a ) a regional interview board shall consist, in the case of a competition to select a member for promotion to the rank of sergeant, of—

(i) a chief superintendent,

(ii) a superintendent, and

(iii) a person having knowledge of, and experience in, personnel management in an organisation other than the Garda Síochána,

( b ) a regional interview board shall consist, in the case of a competition to select a member for promotion to the rank of inspector, of

(i) an assistant commissioner,

(ii) a chief superintendent, and

(iii) a person having knowledge of, and experience in, personnel management in an organisation other than the Garda Síochána,

( c ) a central interview board shall consist, in the case of a competition to select a member for promotion to the rank of sergeant, of

(i) a chief superintendent,

(ii) a superintendent, and

(iii) a person having knowledge of, and experience in, personnel management in an organisation other than the Garda Síochána,

( d ) a central interview board shall consist, in the case of a competition to select a member for promotion to the rank of inspector, of

(i) an assistant commissioner,

(ii) a chief superintendent, and

(iii) a person having knowledge of, and experience in, personnel management in an organisation other than the Garda Síochána,

( e ) an interview board shall consist, in the case of a competition to select a member for promotion to the rank of superintendent, of

(i) two persons, one being either the Commissioner or a deputy commissioner, and the other being either a deputy commissioner or an assistant commissioner, and

(ii) a person having knowledge of, and experience in, the selection of persons for appointment to senior management positions in an organisation other than the Garda Síochána, and

( f ) an interview board shall consist, in the case of a competition to select a member for promotion to the rank of chief superintendent, of

(i) the Commissioner,

(ii) a deputy commissioner, and

(iii) a person having knowledge of, and experience in, the selection of persons for appointment to senior management positions in an organisation other than the Garda Síochána.".
