OIL POLLUTION OF THE SEA (CIVIL LIABILITY AND COMPENSATION) ACT, 1988 (INSURANCE OF SHIPS) REGULATIONS, 1992.

I, MICHAEL WOODS, Minister for the Marine, in exercise of the powers conferred on me by sections 16 and 45 of the Oil Pollution of the Sea (Civil Liability and Compensation) Act, 1988 (No. 11 of 1988), hereby make the following Regulations:

1. These Regulations may be cited as the Oil Pollution of the Sea (Civil Liability and Compensation) Act, 1988 (Insurance of Ships) Regulations, 1992.

2. A ship registered in the State shall not carry in bulk a cargo of 2,000 tonnes or more of oil unless there is in force in respect of that ship a contract of insurance, or other financial security approved of by the Minister in respect of liability for pollution damage indemnifying the owner of the said ship for an amount which is at least 14 million units of account, or 133 units of account per tonne for each tonne of the ship's tonnage, whichever is the lesser.

3. A ship which is not registered in the State or in another Convention country shall not carry to or from a harbour, terminal installation or offshore terminal in the State a cargo of 2,000 tonnes or more of oil in bulk unless there is in force in espect of that ship a contract of insurance, or other financial security, approved of by the Minister in respect of liability for pollution damage indemnifying the owner of the said ship for an amount which is at least 14 million units of account, or 133 units of account per tonne for each tonne of the ship's tonnage, whichever is the lesser.

4. There shall be charged a fee of £30 in respect of each certificate issued under section 16 (2) of the Oil Pollution of the Sea (Civil Liability and Compensation) Act, 1988 .

EXPLANATORY NOTE.

These Regulations provide that ships which carry 2,000 tonnes or more of crude or fuel oil shall have insurance against pollution damage which will meet the requirements of the Minister for the Marine.
