OCCUPATIONAL BENEFIT SCHEMES (EQUAL TREATMENT) REGULATIONS, 1992. | ||
The Minister for Social Welfare, in exercise of the powers conferred on him by section 5 and section 71 (3) (as inserted by section 62 of the Social Welfare Act, 1992 ) of the Pensions Act, 1990 (No. 25 of 1990), hereby makes the following Regulations: | ||
1 Citation. | 1. These Regulations may be cited as the Occupational Benefit Schemes (Equal Treatment) Regulations, 1992. | |
2 Commencement. | 2. These Regulations shall come into operation on the 1st day of January, 1993. | |
3 Equal Treatment. | 3. The period prescribed for the purposes of section 71 (3) shall be— | |
( a ) a period of 25 years (commencing on 1 January, 1993) for the purposes of retirement ages; and | ||
( b ) a period of 6 years (commencing on 1 January, 1993) in any other case. | ||

EXPLANATORY NOTE. | ||
These Regulations allow that in applying the principle of equal treatment in occupational benefit schemes from 1 January 1993 under the provisions of the Pensions Act, entitlements which accrued prior to 17 May 1990 under pensions scheme rules may be retained for a period of 25 years where they arise from the application of different retirement ages for men and women and 6 years in any other case. |
