SOCIAL WELFARE (MODIFICATIONS OF INSURANCE) (AMENDMENT) REGULATIONS, 1991.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 and 7 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981), hereby makes the following Regulations:—

1 Short title and collective citation.

1. (1) These Regulations may be cited as the Social Welfare (Modifications of Insurance) (Amendment) Regulations, 1991.

(2) These Regulations and the Social Welfare (Modifications of Insurance) Regulations, 1991 ( S.I. No. 94 of 1991 ) shall be construed together as one and may be cited together as the Social Welfare (Modifications of Insurance) Regulations, 1991.

2 Commencement.

2. These Regulations shall come into operation—

(a) on the 28th day of November, 1991 as respects retirement pension, and

(b) on the 29th day of November, 1991 as respects old age (contributory) pension.

3 Amendment of 1991 Regulations.

3. The Social Welfare (Modifications of Insurance) Regulations, 1991 are hereby amended by—

(a) the insertion in paragraph (b) of sub-article (2) of article 5 of "subject to articles 7 and 10 of the Social Welfare (Old Age (Contributory) Pension and Retirement Pension) Regulations, 1991," before "employment contributions",

(b) the insertion in paragraph (b) of sub-article (2) of article 6 of "subject to articles 7 and 10 of the Social Welfare (Old Age (Contributory) Pension and Retirement Pension) Regulations, 1991," before "employment contributions", and

(c) the insertion in paragraph (b) of sub-article (2) of article 7 of "subject to articles 7 and 10 of the Social Welfare (Old Age (Contributory) Pension and Retirement Pension) Regulations, 1991," before "employment contributions".

EXPLANATORY NOTE.

This Regulation amends the Social Welfare (Modifications of Insurance) Regulations to allow contributions at the modified rate to be taken into account for the purposes of calculating the pro-rata mixed insurance pensions.
