EUROPEAN COMMUNITIES (COSMETIC PRODUCTS) (AMENDMENT) REGULATIONS, 1991.

The Minister of Health in exercise of the powers conferred on her by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby makes the following Regulations:—

1. These Regulations may be cited as the European Communities (Cosmetic Products) (Amendment) Regulations, 1991.

2. These Regulations shall be construed as one with the European Communities (Cosmetic Products) Regulations, 1990 ( S.I. No. 265 of 1990 ) and may be cited with those Regulations as the European Communities (Cosmetic Products) Regulations, 1990 and 1991.

4. These Regulations shall come into operation on 1st day of January 1992.

5. Article 4 (1) of the European Communities (Cosmetic Products) Regulations, 1990 is hereby amended by the addition thereto in the definition of "the Principal Directive" of the reference "91/184/EEC25".

6. The provisions of Article 7 (1) of the European Communities (Cosmetic Products) Regulations, 1990 shall not apply until the 1st day of January 1993 as respects the requirements of Commission Directive 91/184/EEC insofar as that Directive relates to the substances referred to in paragraphs (2) to (9) of Articles 1 thereof.

7. The provisions of Article 7 (5) of the European Communities (Cosmetic Products) Regulations, 1990 shall not apply—

(i) until the 31st day of December 1992, as respects the requirements of Commission Directive 91/184/EEC insofar as that Directive relates to the substances referred to in paragraph (1) of Article I thereof, and

(ii) until the 31st day of December 1994, as respects the requirements of Commission Directive 91/184/EEC insofar as that Directive relates to the substances referred to in paragraphs (2) to (9) of Article 1 thereof.

EXPLANATORY NOTE.

The purpose of these Regulations is to update the principal regulations by giving effect to the Thirteenth Commission Directive on cosmetic products (91/184/EEC).

The effect of the Regulations is to further safeguard public health in regard to the substances which may be contained in cosmetic products.

The use of certain additional substances is permitted while the use of certain other substances is prohibited or permitted subject to certain restrictions and conditions.
