EUROPEAN COMMUNITIES (SAMPLING AND ANALYSIS OF FERTILISERS) REGULATIONS, 1991.

I, MICHAEL O'KENNEDY, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive No. 89/519/EEC of 1 August 1989(1), hereby make the following Regulations:

(1)O.J. No. L265/3O, 12.9.1989.

1. (1) These Regulations may be cited as the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1991, and shall come into operation on the 25th day of November, 1991.

(2) The European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 to 1989, and these Regulations may be cited together as the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 to 1991.

2. Regulation 2 of the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 ( S.I. No. 12 of 1978 ), is hereby amended by the substitution for the definition of "the directive" (inserted by the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1989 ( S.I. No. 179 of 1989 )), of the following definition:

"'the Directive' means Commission Directive No. 77/535/EEC of 22 June 1977(2), as amended by—

(a) Commission Directive No. 79/138/EEC of 14 December 1978(3),

(3)O.J. No. L39/3, 14.2.1979.

(b) Commission Directive No. 87/566/EEC of 24 November 1987(4), and

(4)O.J. No. L342/32, 4.12.1987.

(c) Commission Directive 89/519/EEC of 1 August 1989.".

3. References in the European Communities (Marketing of Fertilisers) Regulations, 1978 ( S.I. No. 13 of 1978 ), to the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978, shall be construed as references to the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 to 1991.

EXPLANATORY NOTE.

The Regulations lay down official methods of analysis for fertilisers containing calcium, magnesium, sodium and sulphur.
