ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF CLARE) REGULATIONS, 1991.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Clare) Regulations, 1991.

2 Commencement.

2. These Regulations shall come into operation on the 5th day of November, 1991.

3 Interpretation.

3. In these Regulations save where the context otherwise requires—

"the Act" means the Road Traffic Act, 1961 ;

"built-up area speed limit" and "special speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road;

"National Road" means a road declared to be a National Road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such road shall be a reference to the number of such road as shown in column 1 of the First Schedule or column 1 of the Second Schedule to the aforementioned Order;

"perimeter road" means a road on and along the roadway of which there runs the boundary of an urban district or a town and shall be considered as being within such boundary for the purposes of these Regulations;

"road" means a public road.

4 Built-up area Speed limit.

4. (1) Each of the Roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. (1) Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

(2) Fifty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Fourth Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7. The Road Traffic (Speed Limits) (County of Clare) Regulations, 1987 ( S.I. No. 126 of 1987 ) are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Act.

1. The following roads in the town of Kilkee:

( a ) The Back Road to Termon, the Lisdeen Road.

( b ) The Kilrush Road (National Road N67) for a distance of 315 metres from the town boundary.

( c ) The Kiltenane or Bansha Road for a distance of 778 metres from the town boundary.

( d ) The Doonbeg Road for a distance of 550 metres from the point where the town boundary intersects the north-western side of the road.

( e ) The Doonlicky Road for a distance of 915 metres from the point where the town boundary intersects the northern side of the road.

( f ) The Bog Road between the town boundary and a point 92 metres from its junction with the Circular Road,

2. The following roads in the Urban District of Kilrush:

( a ) The Monvana Road (North), the Doonbeg Road.

( b ) The Ennis Road (National Road N68) for a distance of 350 metres from the urban district boundary.

( c ) The Kildysert Road for a distance of 556 metres from the urban district boundary.

( d ) The Knock Road (National Road N67) for a distance of 476 metres from the point where the urban district boundary intersects the north-eastern side of the road.

( e ) The Shanakyle Road for a distance of 336 metres from the urban district boundary.

( f ) The Pella Road for a distance of 320 metres from the urban district boundary.

( g ) The Cooraclare Road for a distance of 550 metres from the urban district boundary.

( h ) The Kilkee Road (National Road N67) from a point where the boundary of the urban district council intersects the southern side of the road to a point 100 metres south of its junction with the Doonbeg Road.

3. The following roads in the town of Shannon:

( a ) All the roads in the area which lies between the boundary of the town of Shannon and a line drawn as follows:

commencing at the point where the boundary of the said town intersects the north-western edge of the Shannon-Ballycasey road, thence in a straight line to a point on the south-eastern edge of the Shannon-Ballycasey road opposite the last mentioned point, thence in a north-easterly direction along the south-eastern edge of the Shannon-Ballycasey road to its intersection with the north-eastern edge of the Aidan Park road, thence along the north-eastern edge of the Aidan Park road to a point 940 metres south-east of the junction of the said road with the Shannon-Ballycasey road, thence in a straight line to the south-eastern terminal point of Sli-na-Mara Road, thence in a straight line to the south eastern terminal point of Corrib Drive, thence in a straight line to the southernmost point on Drumgeely Hill road and thence in a straight line to the point on the boundary of the town of Shannon nearest to the last mentioned point.

( b ) The Shannon-Ballycasey road where the said road is a perimeter road.

SECOND SCHEDULE.

Roads declared to be public roads in a built-up area for the purpose of section 45 of the Act.

1. The following roads at Ballynacally:

( a ) The Ennis-Kildysert road between a point 150 metres north-east of its junction with the Roscliff Road and a point 40 metres south-west of its junction with the Cloonakilla Road.

( b ) The Roscliff Road for a distance of 165 metres from its junction with the Ennis-Kildysert road.

( c ) The Kilcreest Road for a distance of 40 metres from its junction with the Ennis-Kildysert road.

( d ) The Cloonakilla Road for a distance of 30 metres from its junction with the Ennis-Kildysert road.

2. The following roads at Ballyvaughan:

( a ) The Lisdoonvarna-Galway road (National Road N67) between a point 300 metres south of its junction with the Fanore Road and a point 87 metres north-east of its junction with the Sheds Road.

( b ) The Fanore Road for a distance of 705 metres from its junction with the Lisdoonvarna-Galway road (National Road N67).

( c ) The School Road for a distance of 310 metres from its junction with the Ballyvaughan-Fanore road.

( d ) St. Joseph's Road for a distance of 258 metres from its junction with the Lisdoonvarna-Ballyvaughan road (National Road N67).

( e ) Sheds Road for a distance of 70 metres from its junction with the Galway Road (National Road N67).

( f ) Pier Road for a distance of 280 metres from its junction with the Fanore-Ballyvaughan road.

3. The following roads at Bodyke:

( a ) The Ennis-Scarriff road between a point 145 metres south of its junction with the Clonmoher Road and a point 240 metres south-east of its junction with the Broadford Road.

( b ) The Clonmoher Road for a distance of 130 metres from its junction with the Ennis-Scarriff road.

( c ) The Broadford road for a distance of 210 metres from its junction with the Ennis-Scarriff road.

4. The following roads at Broadford:

( a ) The Scarriff-Limerick road between a point 65 metres north-west of its junction with the Violet Hill Road and a point 96 metres south of its junction with the Bridgetown Road.

( b ) The Violet Hill Road for a distance of 46 metres from its junction with the Scarriff-Limerick road.

( c ) The O'Callaghan's Mills Road for a distance of 101 metres from its junction with the Scarriff-Limerick road.

( d ) The Kinseily Road for a distance of 120 metres from its junction with the Scarriff-Limerick road.

( e ) The Bridgetown Road for a distance of 257 metres from its junction with the Scarriff-Limerick road.

( d ) Carrigaholt Castle Road for a distance of 10 metres from its junction with Main Street.

6. The following roads at Clarecastle:

( a ) The Fair Green Road.

( b ) The Limerick-Ennis road (National Road N18) between its junction with the Quin Road and the boundary of the urban district of Ennis.

( c ) Patrick Street or Main Street between its junction with the Limerick-Ennis road (National Road N18) and its junction with the Island McGrath Road.

( d ) Quay Road and all roads connecting it with the Limerick-Ennis road (National Road N18).

7. The following roads at Cloonlara:

( a ) The Truagh-Doonass road between a point 305 metres north-west of its junction with the Gillogue Road and a point 245 metres south-east of the said junction.

( b ) The Gillogue Road for a distance of 844 metres from its junction with the Truagh-Doonass road.

8. The following roads at Connolly:

( a ) The Ennis-Milltown Malbay road between a point 830 metres south-east of its junction with the Inagh Road and a point 370 metres south-west of the said junction.

( b ) The Inagh Road for a distance of 50 metres from its junction with the Ennis-Milltown Malbay road.

9. The following roads at Cooraclare:

( a ) The Kilrush-Milltown Malbay road between a point 40 metres west of its junction with the Tiernaglohane Road and a point 45 metres north of its junction with the Danganella Road.

( b ) The Tiernaglohane Road for a distance of 25 metres from its junction with the Kilrush-Milltown Malbay road.

All roads in the area enclosed by a line commencing at a point on the Ennis Road 110 metres south-east of its junction with the Circular Road and drawn thence in straight lines successively to the following points:

( a ) a point on the Pound Road 65 metres east of its junction with the Circular Road,

( b ) a point on the Lisdoonvarna Road (National Road N67) 101 metres north of its junction with the Sroohill Road,

( c ) a point on the Sroohill Road 92 metres north-west of its junction with the Lisdoonvarna Road (National Road N67),

( d ) a point on the Lahinch Road (National Road N67) 250 metres west of its junction with the Bogberry Road,

All roads in the area enclosed by a line commencing at a point on the Kilfenora-Corofin road 110 metres south-east of its junction with the Lisdoonvarna Road and drawn thence in straight lines successively to the following points:

( a ) a point on the Noughaville Road 65 metres from its junction with the Lisdoonvarna Road,

( b) a point on the Lisdoonvarna Road 297 metres from its junction with the Corofin Road,

( c ) a point on the Smithstown Road 93 metres from its junction with the Ennistymon Road,

( d ) a point on the Ennistymon Road 189 metres south-west of its junction with the Smithstown Road,

( b ) The Limerick-Ennis road (National Road N18) between a point 120 metres west of its junction with the Sixmilebridge Road on the Ennis-bound carriageway and a point 360 metres east of the said junction on the said carriageway.

( c ) The Sixmilebridge Road for a distance of 20 metres from its junction with the Limerick-Ennis road (National Road N18).

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County of Clare) Regulations, 1987 ( S.I. No. 126 of 1987 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the first Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule.

The Regulations also prescribe a speed limit of 50 miles per hour in respect of the public roads mentioned in the Fourth Schedule.

Ambulance, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
