COMPETITION ACT, 1991 (COMMENCEMENT) ORDER, 1991.

I, DESMOND O' MALLEY, Minister for Industry and commerce, in exercise of the powers conferred on me by section 2 of the Competition Act, 1991 (No. 24 of 1991), hereby order as follows:

1. This Order may be cited as the Competition Act, 1991 (Commencement) Order, 1991.

2. In this Order, "the Act" means the Competition Act, 1991 .

3. Subject to paragraph 4 of this Order, the Act shall come into operation on the 1st day of October, 1991, and the Competition Authority shall stand established on that day.

4. This Order does not apply to—

(a) section 6 (2) ( b ) of the Act,

( b ) section 22 of the Act in so far as it provides for the repeal of—

(i) the following order made under section 8 (1) of the Act of 1972—

Restrictive Practices (Groceries) Order, 1987 ( S.I. No. 142 of 1987 ), and

(ii) for the purposes only of the said Order, the following provisions of the Act of 1972, as amended by the Act of 1987, namely, sections 1, 8 (2), 13 (2), 14 (1) (b), 14 (3), 14 (4), 15, 19, 20, 22, 23, 24 and 27 and paragraphs, 3, 6, 7 and 8 of the Second Schedule,

(iii) section 6 of the Act of 1987.

EXPLANATORY NOTE.

This Order brings the main provisions of the Competition Act, 1991 , into effect from 1 October, 1991. It establishes the Competition Authority from that date. The Order also retains the Restrictive Practices (Groceries) Order, 1987.
