EUROPEAN COMMUNITIES (PAINTS, Etc.) (CLASSIFICATION, PACKAGING AND LABELLING) (AMENDMENT) REGULATIONS, 1991.

I, BERTIE AHERN, T.D., Minister for Labour, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive No. 89/451/EEC of 17 July, 1989(1) hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Paints, etc.) (Classification, Packaging and Labelling) (Amendment) Regulations, 1991.

(2) The European Communities (Paints, etc.) (Classification, Packaging and Labelling) Regulations, 1980, the European Communities (Paints, etc.) (Classification, Packaging and Labelling) (Amendment) Regulations, 1984, the European Communities (Paints, etc.) (Classification, Packaging and Labelling) (Amendment) Regulations, 1987, and these Regulations may be cited together as the European Communities (Paints, etc.) (Classification, Packaging and Labelling) Regulations, 1980 to 1991.

2. These Regulations shall come into operation on the 1st day of July, 1991.

3. The European Communities (Paints, etc.) (Classification, Packaging and Labelling) Regulations, 1980 ( S.I. No. 365 of 1980 ), are hereby amended by the substitution of the following definition for the definition of "the Directive" in Regulation 3 (inserted by the European Communities (Paints, etc.) (Classification, Packaging and Labelling) (Amendment) Regulations, 1987 ( S.I. No. 205 of 1987 )):

"'the Directive' means Council Directive No. 77/728/EEC of 7 November 1977(2) as amended by Commission Directive No. 81/916/EEC of 5 October 1981(3), Council Directive No. 83/265/EEC of 16 May 1983(4), Commission Directive No. 86/508/EEC of 7 October 1986(5) and Commission Directive No. 89/451/EEC of 17 July 1989(1) ;".

4. These Regulations shall be deemed to be an existing enactment within the meaning of section 2 of the Safety, Health and Welfare and Work Act, 1989 and shall be construed and have effect accordingly.

EXPLANATORY NOTE.

These Regulations implement, with effect from 1st July, 1991, Commission Directive No. 89/451/EEC of 17 July, 1989, and provide for an amendment to Annex II of Council Directive No. 77/728/EEC of 7 November, 1977.

The amendment to Annex II provides that the labels of packages of paints and varnishes shall be required to contian a warning to the effect that the paint or varnish contains lead where the level of lead exceeds 0.15%.
