EUROPEAN COMMUNITIES (PROHIBITION OF CERTAIN ACTIVE SUBSTANCES IN PLANT PROTECTION PRODUCTS) (AMENDMENT) REGULATIONS, 1990.

I, MICHAEL O'KENNEDY, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purpose of giving effect to Council Directive No. 90/533/EEC of 15 October 19901, and giving further effect to Council Directive No. 79/117/EEC of 21 December 19782, hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Prohibition of Certain Active Substances in Plant Protection Products) (Amendment) Regulations, 1990.

(2) The European Communities (Prohibition of Certain Active Substances in Plant Protection Products) Regulations, 1981 to 1987, and these Regulations may be cited together as the European Communities (Prohibition of Certain Active Substances in Plant Protection Products) Regulations, 1981 to 1990, and shall be construed together as one.

2. In these Regulations—

"the Principal Regulations" means the European Communities (Prohibition of Certain Active Substances in Plant Protection Products) Regulations, 1981 ( S.I. No. 320 of 1981 );

"the Regulations of 1987" means the European Communities (Prohibition of Certain Active Substances in Plant Protection Products) (Amendment) (No. 2) Regulations, 1987 ( S.I. No. 342 of 1987 ).

3. (1) Part I of the Schedule to the Principal Regulations is hereby amended by the addition to the entry headed "C" Other Compounds:—" (inserted by the Regulations of 1987 of the following after the compound numbered 4:

"5. Dinoseb, its acetate and salts,

6. Binapacryl,

7. Captafol,

8. Dicofol containing less than 78% of p.p.1 — dicofol or more than 1 g/kg DDT and DDT related compounds,

9. ( a ) Maleic hydrazide and its salts, other than its choline, potassium and sodium salts;

( b ) Choline, potassium and sodium salts of maleic hydrazide containing more than 1 mg/kg of free hydrazide expressed on the basis of the acid equivalent,

10. Quintozene containing more than 1 g/kg of HCB or more than 10 g/kg pentachlorobenzene."

(2) Paragraph (1) of this Regulation shall come into operation—

( a ) in so far as it relates to the compound numbered 8, on the 30th day of September, 1990, and

( b ) in every other case, on the 31st day of December, 1990.

4. (1) Paragraphs 2 (b) and (3) of Regulation 3 of the Principal Regulations are hereby revoked.

(2) Regulation 5 (as amended by the European Communities (Prohibition of Certain Active Substances in Plant Protection Products) (Amendment) (No. 2) Regulations, 1985 ( S.I. No. 237 of 1985 )) of the Principal Regulations is hereby amended by the deletion in paragraph (5) (a) (ii) of the words "or used for purposes not authorised under Regulation 3 (2) of these Regulations".

(3) Part II of the Schedule to the Principal Regulations (as amended by the Regulations of 1987) is hereby revoked.

(4) This Regulation shall come into operation on the 30th day of June, 1991.

EXPLANATORY NOTE.

The Regulations amend previous Regulations on the prohibition of certain active substances in plant protection products by prohibiting additional active substances in plant protection products and limiting the derogation which permitted the use of mercury in certain circumstances up to 30/6/1991.
