AIR NAVIGATION (EUROCONTROL) (ROUTE CHARGES) (AMENDMENT) REGULATIONS, 1990.

I, SÉAMUS BRENNAN, Minister for Tourism and Transport, in exercise of the powers conferred on me by section 12 (as inserted by section 1 of the Air Navigation (Eurocontrol) Act, 1971 (No. 19 of 1971), and amended by section 14 of the Air Navigation (Eurocontrol) Act, 1983 (No. 38 of 1983)), of the Air Navigation (Eurocontrol) Act, 1963 (No. 15 of 1963), and the Communications (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1987 ( S.I. No. 92 of 1987 ), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Air Navigation (Eurocontrol) (Route Charges) (Amendment) Regulations, 1990, and shall come into operation on the 1st day of January, 1991.

(2) The Air Navigation (Eurocontrol) (Route Charges) Regulations, 1989 ( S.I. No. 362 of 1989 ), and these Regulations may be cited together as the Air Navigation (Eurocontrol) Regulations, 1989 to 1990.

2. The Air Navigation (Eurocontrol) (Route Charges) Regulations, 1989 ( S.I. No. 362 of 1989 ), are hereby amended by—

( a ) the substitution in Regulation 2 for the definition of "the relevant airspace" by the following definition:

" 'the relevant airspace' means the airspace the lateral and vertical extent of which are as follows:

( a ) the lateral extent shall be the area provided by straight lines joining the following coordinates:

( b ) (i) the vertical extent in subparagraph (a) (i) of this paragraph shall extent from ground level with no upper limit, and

(ii) the vertical extent in (a) (ii) above shall extend from Flight Level 55 with no upper limit."

( b ) the addition in Regulation 2 of the following definition after the definition of Member State:

" 'flight level' means a surface of constant atmospheric pressure which is related to a specific pressure datum, 1 013.2 hectopascals (hPa), and is separated from other such surfaces by specific pressure intervals."; and

( c ) the substitution for Part II of Schedule to the Regulations, of following Part:

"Part II

Official Entry/Exit Points for Aircraft Entering and Leaving Irish Airspace as set out in Aeronautical Information Publication (AIP) Ireland.

EXPLANATORY NOTE.

These Regulations, which will come into operation on 1 January 1991, amend the Air Navigation (Eurocontrol) (Route Charges) Regulations, 1989 in order to provide for the inclusion in Irish airspace of the block of airspace to the south-west of Ireland known as the Shannon Oceanic Transition Area (SOTA).
