EUROPEAN COMMUNITIES (RADIO INTERFERENCE FROM ELECTRICAL HOUSEHOLD APPLIANCES, PORTABLE TOOLS AND SIMILAR EQUIPMENT (AMENDMENT) REGULATIONS, 1990.

I, RAY BURKE, Minister for Communications, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and section 3 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and for the purpose of giving effect to Commission Directive 87/308/EEC(1) of 2nd June, 1987, hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Radio Interference from Electrical Household Appliances, Portable Tools and Similar Equipment) (Amendment) Regulations, 1990.

2. The European Communities (Radio Interference from Electrical Household Appliances, Portable Tools and Similar Equipment) Regulations, 1979 ( S.I. No. 170 of 1979 ), are hereby amended—

( a ) in paragraph (1) of Regulation 2, by the substitution for the definition of "the Council Directive" of the following:

"'the Council Directive' means Council Directive 76/889/EEC of 4th November, 1976, as amended by Commission Directive 87/308/EEC of 2nd June, 1987;",

and ( b ) by the substitution for Regulation 7 (inserted by the European Communities (Radio Interference from Electrical Household Appliances, Portable Tools and Similar Equipment) (Amendment) Regulations, 1983 ( S.I. No. 339 of 1983 )) of the following:

"7. Examinations, tests and measurements for the purpose of verifying compliance with the Council Directive shall be in accordance with the provisions of the Annex to the Council Directive.".

EXPLANATORY NOTE.

The purpose of these Regulations is to give legal effect to Commission Directive 87/308/EEC. This Directive has the effect of replacing the Annex to an earlier Council Directive (76/889/EEC) and was necessary because of improvements to the technical requirements for compliance with the Directive. Both Directives aim at the harmonisation of the laws of E.C. member states relating to the suppression of radio interference caused by electrical household appliances, portable tools and similar equipment.
