PRESIDENTIAL ELECTIONS FREE POSTAGE (AMENDMENT) SCHEME, 1990.

An Post, in exercise of the powers conferred on it by Section 34 of the Presidential Elections Act, 1937 (No. 32 of 1937), and by Section 74 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), having consulted the Minister for the Environment and with the consent of the Minister for Communications, hereby makes the following Scheme:

1. (1) This Scheme may be cited as the Presidential Elections Free Postage (Amendment) Scheme, 1990.

(2) The Presidential Elections Free Postage Regulations, 1959, The Presidential Elections Free Postage (Amendment) Scheme, 1984 (No. 288 of 1984), and this Scheme may be cited as the Presidential Elections Free Postage Schemes, 1959 to 1990.

2. This Scheme shall be construed as one with the Presidential Elections Free Postage Regulations, 1959, and the Presidential Elections Free Postage (Amendment) Scheme, 1984.

3. In this Scheme "the Regulations" mean the Presidential Elections Free Postage Regulations, 1959.

4. The references to the Controller of the Dublin Postal District in Regulation 4 of the Regulations and the First Schedule thereto shall be substituted by "the appropriate officer".

5. Paragraph (b) of Regulation 8 of the Regulations is hereby amended by placing a full stop after the words "of the cover" and deleting the remainder of that paragraph.

6. Regulation 8 of the Regulations is hereby amended by the replacement of the full stop at the end of paragraph (j) with a comma and by the addition of the following paragraph after paragraph (j):

"( k ) subject to the conditions contained in this Regulation, communications shall comply with the statutes and the schemes and regulations affecting postal packets generally."

7. Paragraph (a) of Regulation 9 of the Regulations is hereby amended by the deletion of "£50" in the first line and the substitution of "£100".

8. The Regulations are hereby amended by the deletion of the Third Schedule thereto and by the substitution of the following regulation for Regulation 12:

"12. Communications which cannot be delivered for want of a sufficient address or for any other good reason may be treated by An Post in accordance with the provisions of Regulation 28 of the Inland Post Warrant, 1939 (No. 202 of 1939)."

EXPLANATORY NOTE.

This scheme removes restrictions on the matter which may be included on the address side of election communications which may be sent, free of postage, by candidates in a Presidential Election. The Scheme also increases the amount of the deposit required from candidates who wish to post such communications before they are duly entitled to do so and amends the regulations relating to the treatment of undelivered election communications.
