SOCIAL WELFARE (PRESERVATION OF RIGHTS) (AMENDMENT) REGULATIONS, 1990.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981) and by section 20 of the Social Welfare (No. 2) Act, 1985 (No. 14 of 1985), hereby makes the following Regulations:—

1. These Regulations may be cited as the Social Welfare (Preservation of Rights) (Amendment) Regulations, 1990.

2. In these Regulations "the Regulations of 1989" means the Social Welfare (Preservation of Rights) (Amendment) (No. 2) Regulations, 1989 ( S.I. No. 186 of 1989 ).

3. The Social Welfare (Preservation of Rights) (No. 2) Regulations, 1986 ( S.I. No. 422 of 1986 ) are hereby amended by—

( a ) the substitution of the following definition for the definition of relevant date of adjustment contained in article 3 (as amended by article 3 of the Regulations of 1989):—

" 'relevant date of adjustment' means—

( a ) the 18th day of July, 1990 in the case of unemployment assistance,

( b ) the 19th day of July, 1990 in the case of unemployment benefit,

( c ) the 23rd day of July, 1990 in the case of disability benefit, maternity allowance, injury benefit and disablement benefit,

( d ) the 26th day of July, 1990 in the case of retirement pension, invalidity pension and pre-retirement allowance,

( e ) the 27th day of July, 1990 in the case of old age (contributory) pension.",

( b ) the substitution in sub-article (a) of article 6A (as amended by article 3 of the Regulations of 1989) of "the sum of £14" for "the sum of £16",

( c ) the substitution in sub-article (b) (i) of article 6A (as amended by article 3 of the Regulations of 1989) of "£7," for "£8,", and

( d ) the substitution for sub-article (1A) of article 7 (as substituted by article 2 of the Social Welfare (Preservation of Rights) (Amendment) (No. 3) Regulations, 1989 ( S.I. No. 354 of 1989 )) of the following sub-article:—

"(1A) An increase in a payment under article 6A of these Regulations shall be paid for the duration of the period of continuous entitlement to that payment or until—

( a ) the 19th day of February, 1991 in the case of unemployment assistance,

( b ) the 20th day of February, 1991 in the case of unemployment benefit,

( c ) the 25th day of February, 1991 in the case of disability benefit, maternity allowance, injury benefit and disablement benefit,

( d ) the 27th day of February, 1991 in the case of retirement pension and invalidity pension,

( e ) the 28th day of February, 1991 in the case of old age (contributory) pension and pre-retirement allowance,

whichever is the shorter.".

EXPLANATORY NOTE.

These Regulations provide that the transitional payments being made to persons whose social welfare payments were reduced as a consequence of the revised dependency arrangements introduced under the Social Welfare (No. 2) Act, 1985 will continue to be made up to the end of February, 1991.

The Regulations also provide that the transitional payments of £16 and £8 will be reduced to £14 and £7 respectively with effect from the last week in July, 1990.
