CONTROL OF BULLS FOR BREEDING (PERMITS) (AMENDMENT) REGULATIONS, 1990.

I, MICHAEL O'KENNEDY, Minister for Agriculture and Food, in exercise of the powers conferred on me by sections 3 and 11 of the Control of Bulls for Breeding Act, 1985 (No. 13 of 1985), as adapted by the Agriculture (Alteration of Name of Department and Title of Minister) Order, 1987 ( S.I. No. 97 of 1987 ), hereby make the following Regulations:

1. These Regulations may be cited as the Control of Bulls for Breeding (Permits) (Amendment) Regulations, 1990.

2. The Control of Bulls for Breeding (Permits) Regulations, 1986 ( S.I. No. 333 of 1986 ), are hereby amended—

( a ) in Regulation 3, by the substitution of the following definition for the definition of "small herd":

" 'small herd' means a herd of cattle of which not more than 30 are breeding female cattle (that is to say, cows and breeding heifers) and which is owned by a person who does not engage in the production of milk for public sale.",

( b ) in Regulation 4, by the insertion of the following paragraph after paragraph (d):

"( e ) a person in respect of a bull whose genetic merit as respects such economic traits as the Minister considers appropriate—

(i) has been evaluated in such manner as the Minister considers adequate by reference to such records of performance as the Minister considers appropriate, and

(ii) is, in the opinion of the Minister having regard to the evaluation, of an acceptable standard.",

( c ) in Regulation 5, by the substitution of the following paragraphs for paragraph (a):

"( e ) Every application for a permit under these Regulations shall be addressed to the Secretary, Department of Agriculture and Food (Livestock Breeding Division), Government Building, Farnham Street, Cavan and shall be accompanied by—

(i) in the case of an application by a person referred to in paragraph (a), (b), (d) or (e) of Regulation 4 of these Regulations, a fee of £10, and

(ii) in the case of an application by a person referred to in paragraph (c) of the said Regulation 4, a fee of £20.

( aa ) Where, in the case of an application by a person referred to in the said paragraph (c), the inspection of the bull concerned pursuant to Regulation 6 of these Regulations is carried out at the place where the bull is normally kept, the applicant shall in addition to the fee specified in paragraph (a) (ii) of this Regulation, pay to the said Secretary at the address aforesaid, a fee of £20.",

( d ) by the substitution of the following Regulation for Regulation 7:

"7. (1) A permit granted pursuant to regulation 4 (c) of these Regulations shall, subject to the provisions of these Regulations, cease to have effect on the 31st day of October, 1994,

(2) A permit granted pursuant to the said Regulation 4 (c) that was in force immediately before the 31st day of October, 1989, shall, subject to the provisions of these Regulations, be deemed to have continued in force until the making of these Regulations and shall continue in force thereafter until the 31st day of October, 1994.".

EXPLANATORY NOTE.

These Regulations amend the prescribed circumstances and fees for granting permits authorising persons to have in their possession unregistered bulls.
