MERCHANT SHIPPING (NAVIGATIONAL EQUIPMENT) (AMENDMENT) RULES, 1990.

I, JOHN WILSON, Minister for the Marine, in exercise of the powers conferred on me by section 19 (1) (A) of the Merchant Shipping (Safety Convention) Act, 1952 , (No. 29 of 1952) (inserted by section 11 (b) of the Merchant Shipping Act, 1981 (No. 33 of the 1981)), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), hereby make the following Rules:—

1. These Rules may be cited as the Merchant Shipping (Navigational Equipment) (Amendment) Rules, 1990, and shall come into operation on the 23rd day of April, 1990.

2. The Merchant Shipping (Navigational Equipment) Rules, 1985 ( S.I. No. 280 of 1985 ), are hereby amended:—

( a ) by the insertion in Rule 2(1) after the definition of "the Organisation" the following definitions:

" 'Passenger Certificate Class IIA' means a certificate issued under or pursuant to the Merchant Shipping Acts 1894 to 1983 for ships engaged on voyages of any kind other than international voyages;

'Passenger Certificate Class III' means a certificate so issued for ships engaged only on voyages in the course of which they are at no time more than 70 miles by sea from their point of departure and not more than 18 miles from the coast of the State, and which are at sea only in favourable weather and during restricted periods;";

( b ) by the deletion in Rule 2 (4) (b) of "sea-going";

( c ) by the addition in Rule 3, after paragraph (5), of the following paragraph:

"(5A) Every ship registered in the State having a Passenger Certificate of Class IIA or III shall either—

( a ) be fitted with an echo sounder installation and comply with Part IV of these Rules; or

( b ) be provided with—

(i) two hand lead lines each 45 metres long and each with a lead weighing at least 3 kilograms; and

(ii) in the case of a ship of 1600 tons or over having a Passenger Certificate of Class IIA, an efficient mechanical depth sounding device.";

( d ) by the insertion in Rule 8 of the following proviso

"Provided that in ships registered in the State such information and instructions shall be in English.";

( e ) by the insertion in Rule 11 (1) and (2) after "in the case of ships" of "registered in the State";

( f ) by the insertion in Rule 13 after "fitted" of "or in the case of a ship which is not registered in the State, a gyro compass is fitted";

( g ) by the insertion in Rule 20 (1) after "ship" of "registered in the State";

( h ) by the insertion in Rule 21 (2) after "ship" of "registered in the State"; and

( i ) by the insertion in Rule 41, after "ship" of "registered in the State".

EXPLANATORY NOTE.

The Rules amend the Merchant Shipping (Navigational Equipment) Rules, 1985 ( S.I. No. 280 of 1985 ) by imposing requirements for the fitting of echo sounder installations or depth sounding devices on Class IIA or III ships registered in the State. In addition there are some consequential and minor amendments.
