LOCAL AUTHORITIES (TRAFFIC WARDENS) ACT, 1975 (SECTION 3) (OFFENCES) (AMENDMENT) REGULATIONS, 1990.

The Minister for the Environment in exercise of the powers conferred on him by subsections (1) and (6) of section 3 and section 6 of the Local Authorities (Traffic Wardens) Act, 1975 (No. 14 of 1975) (as amended by section 74 of the Finance Act, 1976 (No. 16 of 1976)) having consulted with the Minister for Justice hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) (Amendment) Regulations, 1990.

(2) These Regulations and the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) Regulations, 1975 to 1986 shall be construed together as one and may be collectively cited as the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) Regulations, 1975 to 1990.

2. In these Regulations:

"the Principal Regulations" means the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) Regulations, 1975 ( S.I. No. 261 of 1975 );

"the 1985 Regulations" means the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) (Amendment) Regulations, 1985 ( S.I. No. 256 of 1985 ).

"the 1986 Regulations" means the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) (Amendment) Regulations, 1986 ( S.I. No. 444 of 1986 ).

3. Article 5 of the Principal Regulations (as substituted by article 4 of the 1985 Regulations and article 3 of the 1986 Regulations) is hereby amended by the substitution of the words "twenty pounds" for the words "fifteen pounds" and the words "fifteen pounds" for the words "ten pounds" in each case where they occur.

4. The Schedule to the Principal Regulations as amended by article 5 of the 1985 Regulations and article 4 of the 1986 Regulations is hereby amended by the substitution of the words "twenty pounds or fifteen pounds" for the words "fifteen pounds or ten pounds" in each case where they occur in the said Schedule.

5. These Regulations shall come into force on the 30th day of January, 1990.

EXPLANATORY NOTE.

These Regulations amend the Traffic Wardens Act, 1975 (Section 3) (Offences) Regulations, 1975 to 1986 by increasing the amount which a person liable to prosecution for an offence to which Section 3 of the Act applies may pay as an alternative to the institution of a prosecution, as follows:—

£15 in respect of a parking offence,

£20 in respect of a clearway offence,

£20 in respect of a bus lane offence.
