GREYHOUND RACE TRACK (RACING) (AMENDMENT) REGULATIONS, 1989.

Bord na gCon in exercise of the powers conferred on it by Section 25 of the Greyhound Industry Act, 1958 (No. 12 of 1958) and also by subsection (3) of Section 5 of the said Act, hereby makes the following regulations, that is to say—

(1) These regulations may be cited as the Greyhound Race Track (Racing) (Amendment) Regulations, 1989.

(2) The Greyhound Race Track (Racing) Regulations, 1967, (No. 133 of 1967) and the Greyhound Race Track (Racing) (Amendment) Regulations, 1982, (No. 138 of 1982) are amended as follows:

By the deletion of sub-article (9) of Article 22 of the Greyhound Race Track (Racing) Regulations, 1967, and the substitution therefor of a sub-article in the following terms:

The draw for trap places, at which the public may be present, shall be made at the time and place designated by the Racing Manager with the consent of the Control Committee. Where there are five runners, trap 4 shall be vacant; where there are four runners traps 2 and 5 shall be vacant; where there are three runners traps 1, 3, 5 shall be vacant; where there are two runners traps, 1, 3, 5 and 6 shall be vacant.

A greyhound classified as a wide runner in any race indicated on the race card and published programme by a "W" against its name or against the trap number shall be a greyhound which in the opinion of the racing manager is best suited to starting outside runners not so classified.

If the advertised particulars of an Open Race or Feature Event state that classification under this regulation will apply, an owner, trainer or authorised agent, when making the entry for such a race or feature event, may request that the greyhound be classified as wide runner for such race or feature event. Notwithstanding whether or not such request is made the Racing Manager shall consider all entries for such a race or feature event and may on the information available to him classify a greyhound as a wide runner under this regulation for such race or for the first round of such feature event. He shall not alter or add to such classifications for any further round of such feature event except that in a feature event of four or more rounds, he may revise them for the second round, in which case the revised classifications shall stand for the remaining rounds. Classifications shall thus not be altered for the semi-final or final of any feature event.

Any request for classification or any classification of a greyhound as a wide runner for an open race or feature event shall apply to that race or feature event only and shall not in itself prejudice any subsequent decision or classification.

(3) By the deletion of sub-article (14) of Article 22 of the Greyhound Race Track (Racing) Regulations, 1967, and the substitution therefor of a sub-article in the following terms:

A reserve greyhound may take the place of a greyhound not declared at time of kennelling (viz half an hour before the start of racing). A reserve shall not replace a withdrawn greyhound if that should entail a wide runner starting inside any runner not so classified.

(4) By the addition of a paragraph to sub-article (4) of Article 23 of the Greyhound Race Track (Racing) Regulations, 1967, in the following terms:

In Classics, Feature Events or sweepstakes where the number of points earned by each greyhound determines the greyhounds to go forward to the next round and a greyhound qualified to go forward is subsequently suspended or disqualified then the greyhound with the next highest number of points shall go forward to the subsequent round or rounds.

(5) By the addition of a paragraph to sub-article 2 (b) of the Greyhound Race Track (Racing) (Amendment) Regulations, 1982 in the following terms:

In any event where the number of points earned by each greyhound determines the greyhounds to go forward to the next round the conditions attached to that event shall decide which greyhound goes forward.

These regulations shall come into operation on the 1st day of July, 1989.

EXPLANATORY NOTE.

The effect of these regulations is to amend the Greyhound Race Track (Racing) Regulations, 1967 and the Greyhound Race Track (Racing) (Amendment) Regulations, 1982 regarding trap draws and qualifiers for subsequent rounds where a points system is in operation.
