INLAND POST AMENDMENT (No. 42) SCHEME, 1989.

AN POST, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983) hereby makes the following Scheme:—

1. (1) This Scheme may be cited as the Inland Post Amendment (No. 42) Scheme, 1989.

(2) This Scheme shall come into force on the 4th day of April, 1989.

2. In this Scheme:—

"the Principal Warrant" means the Inland Post Warrant, 1939 ( S.I. No. 202 of 1939 ).

3. Regulation 3 of the Principal Warrant shall be amended by the insertion of the following definition after paragraph 22 of Regulation 3:

"(23) the expression 'Courier Postal Packet' means a postal packet which An Post undertakes to collect from the sender and to deliver to the addressee".

4. Regulation 5 of the Principal Warrant shall be amended by the addition of the following after paragraph 4 of Regulation 5:

There shall be charged and paid for the conveyance of a courier postal packet the charges specified in the first column of the 7th Schedule. The service shall be subject to the limits of size and weight of the postal packets conveyed referred to in the second column of the same Schedule, to the provisions specified in the third column thereof and to the further provisions contained in the body of this warrant".

5. The Principal Warrant shall be amended by the addition of the following after Regulation 65:

Courier Postal Packet Service

66. The following special conditions shall apply to the Courier Postal Packet Service.

( a ) Payment shall be in such manner as An Post may from time to time prescribe and in such amounts as may be agreed by An Post and the customer provided that no charge shall exceed that set out in the seventh schedule.

( b ) Collection and delivery shall take place only between the hours of 9.30 a.m. and 5.30 p.m. Monday to Friday. No collection or delivery shall take place at weekends or on bank holidays or outside the hours of 9.30 a.m. to 5.30 p.m. unless An Post shall otherwise agree with the customer.

( c ) Collection shall take place in the Dublin Postal District, Dún Laoghaire and Blackrock and in such other place as An Post may from time to time determine.

( d ) Delivery shall take place in the Dublin Postal District, Dún Laoghaire and Blackrock and in such other places as An Post may from time to time determine.

( e ) The provisions of this warrant relating to compulsory registration of postal packets shall not apply to a courier postal packet. In the event that delivery cannot be made at the address of the addressee An Post may return the courier postal packet to the sender or to the customer or may otherwise dispose of it as it thinks fit.

( f ) No courier postal packet shall be registered.

( g ) In the event that An Post fails due to no fault of the customer, the sender or of the addressee to effect same day delivery all postage paid or due by the customer may be repaid or remitted to the customer.

( h ) In the event that any courier postal packet is lost or damaged whilst in the custody of An Post, An Post may pay to the person or persons who may, in the opinion of An Post, establish a reasonable claim to compensation (having regard to the nature of the courier postal packet, the care with which it was packed, and other circumstances) such sum not exceeding £5,000, in respect of such packet as it thinks fit. Nothing in this Regulation shall render An Post liable to any action or other legal proceedings in respect of or in consequence of any such loss or damage and the decision of An Post on all questions arising between it and any person claiming payment in respect of the loss or damage of any article enclosed in or forming part of any courier postal packet shall, be final and conclusive.

6. The Principal Warrant shall be amended by the addition after the sixth schedule of the following:—

If collected by motor cycle £6. If collected by other means of conveyance £12 plus £1 per kg. in excess of 2 kg. whichever is the greater plus waiting time at £1 per 15 minutes. Plus a conveyance and delivery charge of £9 for packets of 1 kg. or less, £11 for packets of 1 to 5 kg. and £1 per additional kg. if the point of delivery and collection are in different cities or towns in the Republic of Ireland. If the point of delivery is outside the Republic of Ireland a conveyance and delivery charge of £40 plus £1.50 for every kg. in excess of 5 kg.

Fragile, bulky or heavy items will not be carried by motor cycle. If the address of the addressee is not in the Republic of Ireland an adhesive customs declaration form in a format approved by An Post plus three copies of a commercial invoice must accompany each courier postal packet.

EXPLANATORY NOTE.

This Scheme, which comes into operation on the 4th day of April, 1989, authorises An Post to carry on a same-day courier service for the collection and delivery of time sensitive items at a premium rate.
